aforesaid one thousand three hundred and twenty Eight pounds of tobacco
215   in form aforesaid Confesseth as also Two hundred & fifteen
pounds of tobacco for his Costs and Charges af.d to the same John Dennis
by the Court here and Consent of the parties af.d adjudged and the aforesaid

County in Maryland planter was Summon'd to answer
unto James Dickerson assignee according to the
form of the act of assembly in Such Case provided
of Nathaniel Brittingham of a plea that he render unto him the quantity
of fifty one Cutts of good Choice Cupruss Timber five foot four Inches long
Seven Eight nine and tenn Inches broad and to afford Eight Nine or teen boards
Each Quarter which to him he oweth and Unjustly detaineth &.a

And Whereupon the said James Dickerson by George Douglas his attorney says
that whereas the said Charles on the twenty ninth day of March Ann Dom
Seventeen hundred & twenty six at Somrset County af.d within the Jurisdiction
of this court by his Certain writing obligatory which the said James sealed
with the seal of the said Charles herewith in to Court brings whose date
is the same day and year af.d did bind himself to pay to the said Nathaniel
Brittingham the quantity of fifty one Cutts of good Cypress timber five foot
four Inches long Seven Eight nine & ten Inches broad & Each quarter to
afford Eight nine & ten boards at the said Brittinghams Landing by the
first day of October then next Ensuing the date of the said writing obligatory
(which said quantity of Cypress timber) the af.d James Dickerson assignee
as af.d of the said Nathaniel averrs to be of the Value of twelve pounds
Fifteen Shillings Currant money of maryland and whereas the af.d Nathaniel
afterwards viz.t on the thirtieth day of September in the year af.d at the County
af.d & within the af.d Jurisdiction by his Certain writing of assignment on the
said writing obligatory Endors'd did assign to the said James all his Right
and title to the said writing obligatory (the af.d quantity of Cypress timber
and Every part thereof to the said Nathaniel then being unpaid)  Nevertheless
the said Charles the af.d fifty one Cutts of Cypress timber of the value af.d to
the af.d James or Nathaniel by the af.d first day of October then next Ensuing
the date of the said writing obligatory nor since that time hath rendred
but the same to the said Nathaniel before the assignment af.d or to the
said James since that time to render hath altogether deny'd and the same
