(235) Therefore he and his pledges of prosecuting be in mercy and the plft name his pledges &.a and that the aforesaid John Murray go thereof without day also it is Considered that the af.d John Murray recover against the af.d Joshua Sturges his damages by occasion of the premisses to one hundred & fifty three 153 pounds of tobacco to the same John by discretion of the Justices here at his request for his Costs and Charges in that part sustained according to the form of the Statute &a by the Court here adjudged &.a
Creek the third Tuesday of November then next to answer unto John Dennis Jun.r of a plea of trespass upon the Case &.a and that thereof he should not fail &a Att which said third Tuesday of November to witt the ninteenth day of the same month Ann Dom One thousand Seven hundred and thirty four being the day of the return of the said writt cometh the said John Dennis Ju.r by Francis Allen his attorney and the Sheriff of Somerset County to whom the foregoing writt was directed likewise Comes and makes return thereof to the Court here Endorsed in these words following Cepi Corpus p Jos: McClester Sher
Complained and as to the damage of the same John Dennis by him by Occasion of the premisses in that part sustained the same Thomas Collins saith and Confesseth that the af.d John Dennis hath sustained damages by occasion of the premisses beyond his Costs and CHarges by him about his Suit in that part apposed to one thousand three hundred and twenty Eight pounds of Tobacco and not more and because the af.d John denys not this but the same allegation Confesseth to be true prays Judgm.t for those damages above Confessed together the promisses beyond his Costs and Charges by him about this Suit in that part apposed to one thousand and three hundred and twenty Eight pounds of Tobacco and not more and because the af.d John denys not this but the same allegation Confesseth to be true prays Judgm.t for those damages above Confessed together with his Costs and Charges aforesaid to him to be adjudged &a Therefore by Consent of the parties af.d it is Considered that the af.d John' Dennis recover against the af.d Thomas Collins his damages aforesaid to the (aforesaid |
