that whereas the af.d Robert the twelfth day of September which was in the year
of our Lord God Seventeen hundred and thirty at Somerset County af.d by his certain
writing obligatory had granted himself to be bound unto the af.d John in the af.d
Sum of Sixty two pounds six shillings current money of maryland and Eleven
hundred and thirty pounds of tobacco to be paid unto the same ^John^ when thereof afterwards
he should be required   Nevertheless the af.d Robert altho' often required the
af.d sum of money and Tobacco unto the af.d John hath not paid but that unto
him hitherto to pay altogether hath refused and still doth refuse to the damage
of the same John sixty pounds Current money and two thousand pounds of
Tobacco and thereupon he brings suit &.a and doth bring hereinto Court the writing
obligatory af.d with the debt af.d in form af.d doth testifie the date whereof
is the same day and year af.d &.a                              pledges &.a  John Doe &
                                                                                                       Rich.d Roe

    And the aforesaid Robert Dyas by William Goldsborough his attorney Cometh & defendeth
the force and Injury when &a and saith that he Cannot gainsay the action afd of the aforesaid John Rider
nor Can he say but that the writing Obligatory afd is the deed of the same Robert Dyas nor but that
he Owes the same John Rider the aforesaid sixty two pounds six shillings Currant money and Eleven
hundred and thirty pounds of tobacco in manner and form as the afd John above against him hath declared &a

                Therefore it is Considered that the aforesaid John Rider Recover against the afd Robert Dyas
his debt afd and his damages by Occasion of the detaining of the Same debt to two hundred and
Ninty Seven                     pounds of tobacco to the Same John Rider of his assent by the Court here
adjudged and the aforesaid Robert in Mercy &a   afterwards to witt the ninteenth day of November
ann.o Dom One thousand Seven hundred and thirty four Cometh here in Court the afd Robert Dyas in his proper
person and upon this the Same Robert is Committed to the prison of the sheriff of Somerset County
by Occasion of the premisses there to remain untill the said John of the debt and damages afd should be thereof
fully Satisfyed &.a the said sheriffe to witt Joseph MccClester Gent present herein Court took Charge
of the said Robert Dyas accordingly &a
