231 that whereas the afd Thomas Billings the Seventeenth day of march which was in the Year of Our Lord God Seventeen hundred and twenty Nine thirty at Somerset County af.d by his certain writing obligatory had granted himself to be bound unto the af.d Thomas Lambden in the af.d Sum of Twenty two pounds Curr.t and lawfull money of this province of maryland to be paid unto the same Thomas Lambden when thereof afterward he should be required Nevertheless the af.d Thomas Billings altho' often required the af.d Twenty two pounds unto the af.d Thomas Lambden hath not paid but that unto him hitherto to pay altogether hath refused and still doth refuse to the damage of the same Thomas Lambden Forty four pounds Curr.t money aforesaid and thereupon he bringeth suit &a and doth bring hereinto Court the writing obligatory af.d which the Debt af.d in form af.d doth testify the date whereof is the same day and year af.d &a pledges &a John Doe & R Roe And the aforesaid Thomas Billings by William Beckingham his attorney Cometh and defendeth the force and Injury when &.a and saith that he cannot gainsay the action af.d of the af.d Thomas Lambden nor can he say but that the writing obligatory af.d is the deed of the same Thomas Billings nor but ^that^ he owes the same Thomas Lambden the aforesaid Twenty two pounds Curr.t and lawfull money of this province in manner and form as the aforesaid Thomas Lambden above against him hath declared &.a Therefore it is Considered that the aforesaid Thomas Lambden recover against the aforesaid Thomas Billings his debt aforesaid and his damages by Occasion of the detaining of the same debt to Two hundred & Eighty 280 pounds of tobacco to the same Thomas Lambden of his assent by the Court here adjudged and the af.d Thomas Billings in mercy &.a
