223 undue before the Laying of the attachment afd that then the said Henry Toadvine shall make restitution unto him the said John Magrawn of all or such part thereof as shall be made appear to be undue &a or that he the said Isaac Handy will do the same for him &a Therefore it is Considered by the Court here that the afd sum of five pounds Eleven shillings so as afd attached & valued be Condemned in the hands of the said Stephen Coston as of the rights and Creditts of the said John Magrawn (to be paid in pork at twelve shillings and six pence P Ct) Towards satisfying unto the said Henry Toadvine his damages and all Costs and Charges accrewing by means of the attachment afd and that the said Henry Toadvine have thereof Execution against the said Stephen Coston according to act of assembly &a whereupon the afd Nat Horsey Garnishee as afd is discharged from the attachment afd &a
to be held at dividing Creek the third Tuesday of November then next to answer unto the Rev.d Alexander Adams principal vestry man and the rest of the vestry men of Stepney parish in the same County of a plea of trespass upon the Case &.a and that thereof he should not fail &.a And the af.d Alexander Adams by William Beckingham his attorney complains against the af.d John Purnell in the plea af.d as followeth Vizt Somerset County ss John Purnell late of Somerset County Gent late high Sheriff of the same County was attached to answer unto the Rev.d Alexander Adams principal vestry man and the rest of the Vestry men of Stepney parish in the same County of a plea of trespass upon the Case &.a And Whereupon the same Alexander Adams and the rest of the s.d Vestry by William Beckingham their attorney complain that whereas the said John the tenth day of March in the Year of our Lord God Seventeen hundred & thirty at Somerset County he the said John then being high sheriff of the same County was Indebted to the s.d Alexander Adams and the rest of the said Vestry in the Quantity of Sixteen thousand nine hundred and Twenty Eight pounds of Tobacco being for the like Quantity of Tobacco by the af.d John of and from the Inhabitants of the said Parish for the use of the said Vestry here before that time collected had and received and so thereof being Indebted the same John in Consideration thereof afterwards to wit the same day and year af.d at the County af.d upon himself did assume and to the same Alexander and the rest (of |
