November Court
1734 (223) Att which said third Tuesday of November to witt the ninteenth day of the same month Ann Dom One thousand seven hundred and thirty four being the day of the return of the said writt Cometh the said Henry Toadvine in his proper person and the Sher of Somerset County to whom the foregoeing writt was directed likewise comes and makes return thereof to the court here Endorsed I Certifie that by vertue of the within writt I have attached on the first day of November in the year within mentioned at Somerset County the sums of money and Tobacco within specified in the hands of Stephen Coston and Nathaniel Horsey severally of the rights and Credits of the within named John Magrawn and at the same time and place made known unto them that they should be and appear at the place within contained to shew Cause as it is likewise within directed if to them or any of them is should seem meet before Francis Porter and John Doe good and lawfull men of my bailywick So answers Jos: Macclester sher Whereupon the afd Stephen Coston Garnishee of the afd John Magrawn appears in his own proper person and says that he Cannot gainsay but that he hath of the rights & Creditts of the said John Magrawn to the Value of Six pounds Six shillings and three pence to be paid in pork at twelve shillings and Six pence P Cent nor Can he Say butt that the same ought to be Condemned in his hands for the Use of the said Henry Toadvine as of the rights and Creditts of the said John Magrawn &a Whereupon the Court Values the afd Four hundred pounds of tob.o so as afd attached in the hands of the said Stephen Coston as of the rights and Creditts of the said John Magrawn at fourteen shillings P Ct which amounts in the whole to two pounds sixteen Shillings Curr.t mony which said two pounds sixteen shillings Curr.t mony the value of the tobacco afd and the afd Two pounds fifteen Shillings Curr.t money in the attachment afd mentioned amounts in the whole to five pounds Eleven shillings Curr.t money &a Thereupon the said Henry Toadvine by Geo Douglas his attorney prays that upon giveing security according to act of assembly in such Case made and provided the afd Sum of Five pounds Eleven shillings Currt money may be Condemned in the hands of the said Stephen Coston as of the rights and Creditts of the said John Magrawn towards satisfying unto the Said Henry Toadvine his damages and all Costs and Charges accrewing by means of the attachment afd &a Whereupon a Certain Isaac Handy of Somerset County Gent present herein Court in his proper person undertakes for the said Henry Toadvine according to act of assembly that in Case the said John Magrawn do att any time within a year and a day appear and make all or any part of the said Henry Toadvines Claim against him to be satisfied or otherwise to be undue |
