(222) Somerset ss Whereas it hath been sufficiently made appear to me the subscriber one of his Lordships Justices of the peace for the County af.d by Henry Toadvine that John Magrawn is run away & hath removed out of this province part of his Substance in order to deceive his Creditors & that the said John Magrawn is indebted to the said Henry Toadvine in the sum of two pounds fifteen Shillings These are therefore in his Lordships name to require you to Issue an attachment against the Estate of the said for the said Sum of two pounds fifteen Shillings and the incident cost and charges pursuant to the act of assembly in that case made and provided and for so doing this shall be your warrant given under my hand this 22d day of August 1734 Geo Dashiell To M.r Tho.s Hayward Clerk of Somerset Court Pursuant to an act of assembly of this province now in force and ^in^ obedience to the above said warrant the following attachment was Issued against the goods Chattles rights or Credits of the af.d John Magrawn the tenor of which writt followeth in these words viz.t Somerset ss Charles absolute Lord and prop.ry of the provinces of maryland and avalon Lord Baron of Baltemore &.a To the sher of Somerset County Greeting wee Command you that you attach any the goods Chattles Rights or Creditts of John Magrawn Late of Somerset County planter if they shall be found in your bailywick to the value of two pounds fifteen Shillings Currant money and Four hundred pounds of tobacco and when you have the same attached or any part thereof the same in your Custody safe keep so that you have the same before our Justices of our County Court of Somerset to be held at dividing Creek the third Tuesday of November next then and there to be Condemned according to act of assembly to and for the use of a Certain Henry Toadvine Unless the said John Magrawn by himself or his attorney shall appear and answer unto the said Henry Toadvine in a plea of trespass upon the Case &a according to law and that by good and lawfull men of your bailywick you make known unto the person or persons in whose hands you make the same attachment that he she or they be and appear before our Justices of our County Court to be held as af.d to shew Cause if any he she or they have why the same goods Chattles Rights or Creditts so attached in his her or their hands ought not to be Condemned and Execution thereof had made (according to act of assembly in such Case made and provided) if to him her or them it shall seem meet and how you shall Execute this writt that you make known unto our said Justices at the day and place af.d and have you then and there this writt Wittness Robert King Gent Chief Justice of our said Court the twenty third day of August In the twentyeth year of Our Dominion &a Ann Dom One thousand Seven hundred and thirty four (Att |
