222 prays an appeal from the Judgment afd so as afd rendered against him to ^the^ next provincial Provinciall Court Court to be held at the City of Annapolis the third tuesday of may next which is unto him granted he giving security for the prosecution of the same appear &a Whereupon the said Francis Porter present here in Court gave security in manner and form following viz.t Maryland ss Know all men by these presents that we Francis Porter James Martin and William Lane of Somerset County are held and firmly bound unto John Meccuddy of the same County in the full and just sum of five thousand pounds of tobacco to be paid to the said John his Ex.rs Adm.rs or assigns to the which payment well and truly to be made and done we bind our selves our heirs Ex.rs and Adm.rs for and in the whole Jointly and severally firmly by those presents sealed with our seals and dated this 23.d day of November 1734 Whereas the above bound Francis Porter hath appealed from a Judgment lately rendred in Somerset County Court against him at the suit of the above named John Meccuddy to the Justices of the provincial Court Now the Condition of the above Obligation is such that if the above bound Francis Porter shall pursue the directions of the act of assembly in such case made and provided and prosecute the same appeal with Effect at the next provincial Court to be held for this province and also satisfie and pay to the said John Meccuddy his Ex.rs Adm.rs or assigns in Case the said Judgment shall be affirmed as well all and singular the debts damages and Costs adjudged by the said County Court and from whose Judgment he hath appealed as also all Costs and damages that shall be awarded by the said provincial Court then the above obligation to be void Else to remain in full force and vertue Sealed & Delivered Fran.s Porter (seal) in presence of us Jam.s Martin (seal) W.m Lane (seal) Ed Rownd Isaac Handy
