219 thirty and four before Robert King Esqr and his associates the said Lord propry his Justices of the same County Court and for the same Lord prop.ry doth give the same Justices hereto understand and be informed that John Elzey late of Somerset parish in the County af.d Gent the fifth day of November in the year of our Lord God Seventeen hundred thirty and four at the parish af.d in the County af.d within the Jurisdiction of this Court in and upon a certain William West of the same County planter in the peace of God and of the same Lord prop.ry then and there being with force and arms an assault did make and the same William West then and there did beat wound and evilly treat so that of his Life it was greatly dispaired and other harms to him then and there did to the great damage of the said William West and against the peace of the said Lord prop.ry that now is his good rule and Government &.a whereupon the Same attorney of the said Lord prop.ry for the same Lord prop.ry prayeth the advice of the Court herein the premisses and that due process of Law in this part against the said John Elzey may be made to answer unto the said Lord prop.ry of and upon the premisses &.a Thereupon Command was given to the sheriffe of Somerset County that he should take the said John Elzey if &.c to answer &.c and afterwards to witt the ninteenth day of November ann Dom one thousand Seven hundred and thirty four before the Justices of his Lordships County Court of Somerset now here held at dividing Creek Cometh the said John Elzey in his proper person according to a Certain Recognizance by him and his pledges in that part before acknowledged and had a hearing of the Information af.d and being Instantly demanded how he would acquitt himself of the premisses af.d by the Information af.d above upon him Imposed says ^that^ of the premisses af.d above upon him Imposed he is Guilty thereof &.a Whereupon all and singular the premisses here being seen heard and fully understood &.a It is Considered by the Court here that the afd John Elzey pay to his Lordship the Lord proprietary for his fine by the Court here upon him Imposed for and by occasion of the trespass & assault afd whereof in form afd he is Convict One shilling Currant money and that the same John Elzey be taken to satisfie his said Lordship of the fine afd &a
discharged &a Whereupon the said Ann Eddes is ordered by the Court to give new recognizance for his good behaviour and appearance at next Court it to be held at dividing Creek the third tuesday of march next &a Whereupon a Certain George Trewitt son of George of |
