206 Att which said next Court to witt the Twentieth day of August anno Dom One thousand seven hundred and thirty four Came again as well the afd Samuel Beckley and Lewis Howell by their attorney afd as the afd Francis Elliott by his attorney afd and because the afd Samuel Beckley and Lewis Howell did not declare against the said Francis Elliott in the plea afd according to a Certain Rule of Court by the parties afd Entered into &.a Therefore they and their pledges of prosecuting be in mercy and Lett the plantiffs name pledges &.a and that the afd Francis Elliott Goe thereof without day also it is Considered that the afd Francis Elliott Recover against the afd Samuel Beckley and Lewis Howell 149 their damages by occasion of the premisses to One hundred & Ninty Four pounds of tobacco to the same Francis Elliott by discretion of the Justices here at his request for his Costs and Charges in that part sustained according to the form of the Statute thereof Lately made and provided adjudged &a
