Att which said next Court to witt the Twentieth day of August anno Dom One thousand seven hundred
and thirty four Came again as well the afd Samuel Beckley and Lewis Howell by their attorney afd
as the afd Francis Elliott by his attorney afd and because the afd Samuel Beckley and Lewis Howell
did not declare against the said Francis Elliott in the plea afd according to a Certain Rule of Court by
the parties afd Entered into &.a
                                                                Therefore they and their pledges of prosecuting be in mercy
and Lett the plantiffs name pledges &.a  and that the afd Francis Elliott Goe thereof without day also
it is Considered that the afd Francis Elliott Recover against the afd Samuel Beckley and Lewis Howell
149   their damages by occasion of the premisses to One hundred & Ninty Four                        pounds
of tobacco to the same Francis Elliott by discretion of the Justices here at his request for his Costs
and Charges in that part sustained according to the form of the Statute thereof Lately made and provided
adjudged &a

     Command was given to the sher of Somerset County that he should take
Robert Deniston Late of somerset weaver if he should be found in his bailywick
and him should safe so that he might have his body before the Justices of
his Lordships County Court of Somerset to be held at dividing Creek ^in the County afd^ the third
Tuesday of June then next to answer unto James Lindow in a plea of trespass
upon the Case &.a and that thereof he should not fail &.a

Att which said third tuesday of June to witt the Eighteenth day of the same month ann Dom One
thousand seven hundred and thirty four being the day of the return of the said writt Cometh the
said James Lindow by Francis Allen his attorney and the sherriff of somerset County to whom the
foregoing writt was Directed Likewise Cometh and maketh return thereof to the Court here
Endorsed in these words following viz.t Cepi Corpus p Joshua Caldwell sherriff

And the said Robert Deniston by William Beckingham his Attorney Comes and defends
the force and Injury when &.a and prays leave thereof to Imparle hereuntill next Court and he hath
it and the same day is given to the aforesaid James Lindow herealso &.a
