and saith that she Cannot gainsay the action afd of the afd William nor Can she say but that she did assume upon
herselfe in manner and form as the afd ^William^ above against him hath Complained and as to the damages of the
same William by him by Occasion of the premisses in that part sustained the same susannah saith & Confesseth
that the afd William hath sustained damages by occasion of the premisses further than his Costs and Charges by
him about his suit in that part apposed to five pounds twelve shillings and six pence Current money of maryland
and not more and becaus the afd William Deneys not this but the same allegation Confesseth to be true prays
Judgment for those damages above Confessed together with his Costs and Charges afd to him adjudged &a

       Therefore it is Considered by Consent of the parties afd that the afd William Whittington Recover
against the afd Susannah Wordie his damages afd to the afd five pounds twelve shillings & six pence Currant
243   money in form afd Confessed as also Two hundred & forty three                             pounds of tobacco
for his Costs and Charges afd to the same William by the Court here and Consent of the parties afd adjudged and the
afd Susannah in mercy &a

     Command was given to the sherriff of Somerset County that he should take
Francis Elliott late of Somerset County Blacksmith if he should be found in his
bailywick and him should safe keep so that he might have his body before the
Justices of his Lordships County Court of Somerset to be held at dividing Creek in the County afd the third tuesday
of June ^then^ next to answer unto Samuel Beckley and Lewis Howell in a plea of trespass upon the Case &.a and that
thereof he should not fail &a
                                                       Att which said third Tuesday of June to witt the Eighteenth day of the Same
month anno Dom One thousand seven hundred and thirty four Being the day of the return of the said writt Cometh the
said Samuel Beckley and Lewis Howell by ^George Douglas^ their attorney afd and the sherriff of Somerset County to whom the foregoing
writt was directed Likewise Cometh and maketh return thereof to the Court here Endorsed in these words following
viz.t Cepi Corpus p Joshua Caldwell sherriff

                Whereupon the ^afd^ Francis Elliott Came here into Court in his proper person and prays that the afd Sam.l
Beckley and Lewis Howell may give Security for Costs in Case non suit may be Obtained against them in
the plea afd which is by the Court Granted   thereupon a Certain George Douglas of Somerset County Gent present
here in Court in his proper person undertook for the said Samuel Beckley and Lewis Howell and assumed
upon himselfe that In Case they be nonsuited in the plea afd or otherwise Legally Cost that then they ^the^
said Samuel Beckley and Lewis Howell shall pay the Condemnation of the Court and all Costs accrewing
thereon to the said Francis Elliott or that he the said George Douglas will do it for them &a

       And the said Francis Elliott by Francis Allen his attorney Comes and defends the force and Injury
       when &.a and prays Leave thereof to Imparle hereuntill next Court and he hath it and the
       same day is Given to the afd Samuel Beckley & Lewis Howell here also &a
