(1) Somerset ss 1733 - 1734 Att a Court of the Right Honourable Charles Absolute Lord and Proprietary of the Provinces of Maryland and Avalon Lord Barron of Baltemore &.c held for Somerset County at Dividing Creek in the Same County the third Tuesday of June (to Witt) the Nineteenth day of the Same Month Anno Dom One thousand Seven hundred and thirty three by his said Lordships Justices the peace in the Same County to keep Assigned of whom were present
Somerset County Greeting Whereas John Stewart Lately in our County Court of Somerset here (to witt) the Twentyth day of June Anno Dom One thousand Seven hundred and Thirty Two before Robt King Gent and his Associates then Justices of our Same Court at Dividing Creek in the County aforesaid by Consideration of the same Court Recovered against James Shirly Gent one of the Attorneys of the County afs.d one thousand four hundred Eighty Seven pounds of Tob.o for his Damages which he sustained as well by occasion of the None performance of a Certain Promise and Assumption to the same John by the afsd James lately Made as for his Costs and Charges by him about his Suit in that part apposed whereof he is Convict as by the Records and proceedings thereof in our Same Court before our Justices at Dividing Creek aforesaid Remaining Manifestly Appeareth and afterwards the aforesaid John Died Entestate after whose Death Administration of all and Singular the Goods and Chattles Rights and Credits which were of the afs.d John at the Time of his Death by David Willson Gent and Dep.ty Comissary for the County afs.d on the thirty first Day of August one thousand seven hundred and thirty two to Sarah Stewart widdow of the aforesaid John Stewart was Comitted as by the Letters of Administration in our Court Before us will appear as on the part of the afs.d Sarah in ^our^ Court before us we have Received and altho' Judgm.t be thereupon Rendered Execution as yet Remaineth to be made as by the Insinuation of the afs.d Sarah we have recd and because we Will that those things which in our Same Court are Rightfully Acted Ought to be duly Executed We Command you that by Honest and Lawfull men of your Balywick you make known unto the said James Shirly that he be and appear before our Justices of our County Court of Somerset to be held at Dividing Creek the third Tuesday of June Next to Shew Cause if any thing for himself he |
