199 afd by their attorneys afd And thereupon the said William Cord prays further Leave thereof to Imparle hereuntill next Court and he hath it and the Same day is given to the afd Robert Bolton here also &a Att which said next Court to witt the twentieth day of August anno Dom One thousand Seven hundred and thirty four Came again as well the afd Robert Bolton as the afd William Cord Jun.r by their attorneys afd and the Said William Cord Saith that he the aforesaid Robert Bolton Condemnation of the premisses so as afd attached in his hands to have ought not because he says that he the said William at the day of the laying of the Attachment afd in his hands had not or at any time since hath had any of the Goods Chattles rights or Creditts of the said Robert Holland in his hands and this he is ready to verify wherefore he prays Judgement if the afd Robert Bolton Condemnation of the premises so as afd attached in his hands to have ought &.a And the aforesd Robert Saith that he by any thing in the s.d Deft.s plea above Alledged from having Condemnation & Execution of the goods afores.d so as afores.d in the return of the writt of Attachment above mentioned to be attached in the hands of him the said William Ought not to be barred because he saith that he the said William at the time of the Impetration of the writt of Attachment afores.d and at the day of the laying of the attachment aforesd in the hands of him the s.d Robert had Goods Chattles Rights & Creditts of the afores.d Robert Holland in his hands to the value of the sum in the return of the attachment mentioned and this he prays may be Inquired of by the Country &c and the afd William Cord Jun.r in like manner Thereupon it is Commanded the sher of Somerset County that Imediately he should Cause to Come here before the Justices of his Lordship County Court of Somerset now sitting at dividing Creek in the County afd Twelve &.a by whome &.a and who neither &.a to recognize &.a because as well &.a and afterwards Imediately Came thereof the Jury &.a and the Jurors of that same Jury by Joseph Macclester Gent Sherriff of the County af.d to this Impannelled being Called came to witt John Donelson Robert Mitchell Jonathan Bounds John Webb John White pocomoke George Benston Ralph Milbourn Angellow Atkinson Jacob Adams Joseph Houston Philip Quinton ^and^ John Atkinson who to say the truth of the premisses afd being duely Elected tryed and Sworn and from the barr of which Court of their Verdict of and upon the premisses to render between themselves to Command together did recede and afterwards to the same Barr for their Verdict in that part to render did return whereupon the afd Robert Bolton altho' Solemnly Called Came not but made default nor is his writt afd further prosecuted &a Therefore it is Considered by the Court here that the afd Robert Bolton take nothing by his writt afd but that he and his pledges of prosecuting be in mercy and Let the names of his said pledges be sought for and that the said William Cord Jun.r Garnishe as afd go thereof without day &a and further it is Considered that the afd William Cord Junr Recover against the afd Robert Bolton 546 five hundred and forty Six pounds of tobacco for his Costs and Charges by (him) |
