all and Singular the goods and Chattells of John Nicholson late of the Same County
Bricklayer dec.d otherwise lately Called John Nicholson of somerset Co.ty
in stepney parish Bricklayer was summoned to answer unto Cap.t Neale
Macclester of the County and province af.d Shipwright of a plea that he
render unto him fifty bushels of Merchantable Indian Corn which from him he u^n^justly detains &.a
And Whereupon the s.d Neale by Francis Allen his attorney saith that whereas the s.d John
in his life time to witt the twenty Eighth day of March in the year of our Lord one thousand seven
hundred thirty and two at Somerset County afs.d within the Jurisdiction of this Court by his certain ^bill^
obligatory which the s.d Neale with the seal of the s.d John in his life time signed here into Court brings
the date whereof is the same day and year did bind himself to pay or cause to be paid to ye afs.d Neale
his heirs or assigns the afs.d fifty bushells of Merchantable Indian corn at a Convenient landing on
Typquin Creek in stepney parish at or upon the twenty seventh day of December next ensuing the date
of the s.d Bill and to the s.d payment well and truly to be made the afs.d John in his life time did bind
himself his heirs Ex.rs and adm.rs firmly by the said Bill  Nevertheless the said John in his life
time nor the afs.d Elizabeth after the death of the said John to whome administration of all and singular
the goods and Chattles Rights and Creditts of the s.d John at the time of his death after the dec^e^ase
of the s.d John in due form of Law ^was^ comitted tho' often required the said fifty bushels of Indian
Corn to the said John have not rendered but the same to him hitherto to render have denied and
the s.d Elizabeth the same to the s.d Neal to render still doth deny and unjustly detain to the
damage of the said Neal of ten pounds Cur money of Maryland and thereupon he brings
Suit &.c                                                                       pledges &.c John Doe & R.d Roe

          And the afd Elizabeth Nicholson admrx as afd by William Beckingham her attorney Comes and Saving to
herselfe all manner of advantages as well to the writt as to the declaration afd prays Leave to Imparle hereuntill
next Court and he hath it and the same day is given to the afd Neal here also &a

    Att which said next Court to witt the Eighteenth day of June anno Dom One thousand Seven hundred and thirty
four Came againe as well the afd Neal MccClester as the afd Eliz.a Nicholson by their attorneys afd and
whereupon the same Eliz.a by her said attorney defends the force and Injury when &.a and saith that the said
And the afs.d Elizabeth admrx as afs.d by Willm Beckingham had appeared & defend ye force
and Injury when &.a  and with the s.d John in his life time did not owe to the s.d Neale the
fifty bushels of corn in the declaration afs.d mentioned or any parcel thereof in manner and
form as the afs.d Neale above against her hath declared and thereof she puts herself upon
the Countrey &.c
