198 Att which said next Court to witt the ninteenth day of march Ann Dom One thousand seven hundred and thirty three Came again as well the afd Robert Nairn as the afd James Nairn by their attorneys afd and whereupon the said James Nairn prays further leave thereof to Imparle hereuntill next Court and he hath it and the same day is given to ^the^ afd Robert herealso &.c Att which said next Court to witt the Eighteenth day of June Ann Dom One thousand seven hundred and thirty four Came again as well the afd Robert Nairn as the afd James Nairn by their attorneys afd and whereupon the said James Nairn prays further leave thereof to Imparle hereuntill next Court and he hath it and the same day is given to the afd Robert herealso &.c Att which said next Court to witt the twentieth day of August Ann Dom One thousand seven hundred and thirty four Came again as well the afd Robert Nairn as the afd James Nairn by their attorneys afd and whereupon the same James Nairn as before defends the force & Injury when &.c and saith that he doth not detain the afd Copper Brandy still and pewter worm and one pair of Cullen Millstones in manner and form as the said Robert above against him hath Complained and of this he puts himself upon the Country &.c and the plft in like manner Thereupon it is Commanded the sherriff of somerset County that Immediately he should cause to Come here before the Justices of his Lordships County Court of somerset now sitting at dividing Creek in the County afd Twelve &.a by whom &.a and who neithere &.a to recognize &.a because as well &.a and afterwards Immediately Came thereof the Jury &.a and the Jurors of that same Jury by Joseph MccClester Gent sherriff of the County afd to this Impannelled being Called came to witt John Donelson Robert Mitchell Jonathan Bounds John Webb, Geo: Benston Ralph Milbourn Angello Atkinson Jacob Adams Joseph Houston Philip Quinton John Atkinson and Samuel Roach who to say the truth of the premisses afd being duely Elected tryed and Sworn upon their Oath doe say that the afd James does detaine from the afd Robert the afd Copper Brandy Still and Pewtor worm and one pair of Cullen Milstones in manner and form as the afd Robert above against him hath Complained and further say upon their Oath that the afd Copper Brandy Still & pewter worm are of the Value of fifteen pounds Currant money of Maryland and that the afd Cullen milstones are of the Value of forty shillings Currant money of maryland and the same Jurors assessed the damages of the Same Robert by occasion of the premisses further than his Costs and Charges by him about his suit in that part apposed to six pence and for those Costs and Charges to one pound of tobacco Therefore it is Considered that the afd Robert Nairn Recover against the afd James Nairn the afd Copper Brandy Still and Pewtor worm and one pair of Cullen Milstones or the afd Seventeen pounds Currant money of Maryland for value of the Same if the Same Robert the afd Copper Brandy Still and pewtor worm and one pair of Cullen Milstones Cannot have againe also his damages afd by the Jurors afd in form afd assessed as also twelve hundred and Eighty two pounds of tobacco for his Costs and Charges at his request by the Court hereof Increas adjudged which Certain damages in the whole do amount to seventeen pounds and six pence Curr money of Maryland & twelve hund.rd & Eighty two pds tob.o & ye afd deft in mercy &c |
