197 and saith he is in noe Sort guilty of the premisses in the declaration afd above mentioned & thereof he putts himselfe upon the Country and the plft in Like manner There^upon^ it is Commanded the sherriff of Somerset County that Immediately he should Cause to Come here before the Justices of his Lordships County Court of Somerset now in Court Sitting at dividing Creek in the County afd twelve &.c by whom &.c and who neither &.c to recognize &.c because as well &.c and afterwards Immediately Came thereof the Jury &.c and the Jurors of that Same Jury by Joseph MccClester Gent sherriff of the County afd to this Impannelled ^being^ Called Came to witt John Donelson Robert Mitchell Jonathan Bounds John Webb John White pocomoke George Benston Ralph Milbourn Angelow Atkinson Jacob Adams Joseph Houston Philip Quinton John Atkinson who to Say the truth in the premisses being duely Elected tryed and Sworn upon thir oath did say that the afd William Gray is not Guilty of the premisses as the afd Benjamin Sharp above against him in manner and form hath Complained Therefore it is Considered that the afd Benjamin Sharp take nothing by his writt and declaration afd but that for his false Clamour he be thereof in mercy and that the afd WIlliam Gray go thereof without day and further it is Considered by the Court that the afd William Gray recover against the afd Benjamin Sharp Eight hundred 892 & Ninty two pounds of tobacco for his Costs and Charges by him about his defence in that part Sustained to the Same William by the Court here according to the form of the Statute in such manner of Case made and provided of his assent adjudged and the afd William have thereof Execution &c
Robert the Twentieth day of August Ann Dom One thousand seven hundred thirty and three at somerset County aforesaid within the Jurisdiction of this Court had delivered unto the aforesaid James One Copper brandy still and pewter worm of the value of thirty pounds Current money and one pair of Cullen Millstones of the value of four pounds Current money to be safely kept and to the same Robert when he should be thereunto afterwards requested to be redelivered Nevertheless the aforesaid James altho' often required the Still and worm aforesaid of the value aforesaid and the one pair of Millstones aforesaid of the value aforesaid unto the said Robert hath not redelivered but the same unto the said Robert to deliver hath altogether refused and denyed and still doth refuse and deny and Unjustly detain wherefore the said Robert saith that he is the worse and hath damage to the value of forty pounds Current Money of maryland and thereupon he brings Suit &.c pledge &.c Jno Doe R Roe And the afd James Nairn by Francis Allen his attorney Comes and defends the force and Injury when &.c and prays Leave thereof to Imparle hereuntill next Court and he hath it and the same day is Given to the afd Robert herealso &.c (Att |
