191 Barrett be taken to Satisfie his said Lordship of the fine afd &a the Sher of Somerset County to witt Joseph MccClester by John Stewart his deputy present took Charge of the said Henry Barrett accordingly Likewise the said Henry Barrett Is ordered by the Court to give Security for fees &a thereupon John Dennis Jun.r present herein Court undertook of the said Henry Barrett in five pounds Sterling for to be LEvied &a In Case he doth not pay for the afd Henry Barrett his Severall Officers Fees due by means of the premisses afd &a
said Heber Whittingham to sign a new Indenture by which new Indenture the said Heber Whittingham hath sold your petitioner to Arthur Warwick who now detaines your petitioner as a Servant by Virtue of the said new Indenture signed by your petitioner in his Servitude your petitioner being Apprehensive he has been free since the 5.th day of this Month Humbly prays your Worships will be pleased to sett your petitioner at Liberty and he as in duty bound will pray &a Thereupon Command was given to the Sherriff of Somerset County that he should Immediately Summons the af.d Arthur Warwick that he be and appear before ye Justices of his Lordships County Court of Somrset now held at Dividing Creek to answer the petition of the af.d Thomas Hopcraft &a Afterwards to wit the twentieth day of August Ann Dom One thousand seven hundred and thirty four before the Justices of his Lordships County Court of Somerset now here held at dividing Creek in and for the County afd Cameth the said Sher to witt Joseph Macclester Gent and made return that he had sumoned the af.d Joshua Warwick as af.d he was Comand thereupon came here into Court as well the af.d petitioner as the af.d Arthur Warwick in the their proper persons and the petition afd being read and heard and the severall allegations as well on the part of the petitioner af.d as on the part of the af.d Arthur Warwick ^heard^ and mature deliberation thereupon had and what severall Evidences delivered upon Oath It appears to the Justices here that the said Thos Hopcraft was detained by his said Master some small time longer than he was to Serve by his first Indenture &a Therefore it is Considered by the Justices here that the afd Thomas Hopcraft goe Free from his said Master Arthur Warwick and that he Serve noe Longer by Vertue of the Same Indenture and Likewise it is Considered that the Same Thos Hopcraft Recover against the 283 said Arthur Warwick pounds of tobacco by the Court here unto him adjudged for his Costs and Charges by him in his part Expended &a Whereupon the said Arthur Warwick prays that the Said Thomas Hopcraft may be adjudged to Serve him for Eight days runaway time and Likewise for Twenty shillings and twenty pounds of tobo paid |
