186 Peter Fischjarrell Aged Sixty Years or there abouts being on the ^Land^ Called Manlove's Discovery Deposeth On the holy Evangelist of Almighty God that Twenty Seven Years agoe or there abouts he this Deponant Used the house of Edward Wheeler the Elder and in Consideration with the Said Wheeler (heard him Say Severall Times that the Land that he the Said Wheeler had Bought of Tho.s Manlove Called Manloves Discovery as he this Deponant Remembers Lying Near the head of Manokin Bridge now in the possession of M.rs Ellis) the Said Thomas Manlove Could make no Good Title too him the Said Edward Wheeler for that the Land or Great part thereof Belonging to Shipway and this Deponant further Saith that he afterwards marryes Margaret Wheeler the Widdow and Relect of the af.d Edward Wheeler and that he has often heard the Said Margarett this Deponants Wife and Edward Wheeler af.d Say that they Lett Samuel Worthington have the Land Called Manloves Discovery and their Bargain therein for the Reasons afd they being Apprehensive they should Loose it or Great part of it by Shipways Survey and further this Deponant Saith not Wee the Subscribers being Duely Quallified as Appears by Indorsment Peter Fischgarrell on a Comission to Us Directed from Somerset County Court and having Comply'd his marke with all the Requsits therein Required by Giving Due Notice Agreeable to Act of Assembly doe Certifie that the above deposition was taken before us and Signed by Fischgarrell this 10th Day of June An 1734 James Strawbridge William Polk Aged Sixty One Years or their abouts Deposeth on Tho.s Browne the holy Evangelist of Almighty God that he was preasent when a pine Stump in the Root of which is now fixt a Ceader post Markt with Sixteen Notches by Consent of Henry Dorman Jun.r Son and heir of Mary Heath and John Finch when the Said Stump was proved by White John Brown and William Heath and Severall Others to be the first Bounder of a Tract of Land Called Deep pattented by John Shipway and this Deponant further Saith that John Brown afores.d told this Deponant that John Shipway had Shewed the afores.d John Browne the above pine (pr Now pine Stump) Sevarall Times in the Root of which the Ceadar post above Mentioned is now fixt as the first Bounder of Deep and further saith he was One of the Jury Brought by Henry Dorman Sen.r ^when^ as the above pine or now pine Stump and now Ceader post was proved as is above Expresst that the first Course from ye said Tree or bounder was Runn According to Pattent by Order of the Then Jury South East the Lenth of One hundred and fifty pole and the Surveyor to Witt Coll William Whittington after the number of perches aforesaid was Runn Out would not be Rul'd by the Jury any further but Run it as he thought fitt himself which afterwards Accasion'd a Great many words between Nathanel Horsey and Samuel Worthington and Coll Whittington with One or both of them the foreman afores.d Nathanel Horsey alledging as well as this Deponant Remembers that there was not any occasion for a Jury being Called there if the surveyor would Runn as he pleased and further Saith Not Hilliam Polke Wee the Subscribers being Duely Quallifed as Appears by Indorsment On a Commission to us Directed from Somerset County Court and having Comply'd with all the Requsits therein Required by Giving Due Notice Agreeable to Act of Assembly do Certifie that the above Deposition was Taken before us by William Polke Senr this 10.th Day of June Ann 1734 James Strawbridge Mathew Dorman aged fifty Six Years or there abouts Deposeth Tho.s Browne On the Holy Evangelist of Almighty God that he was present when a pine (or Now pine Stump) in the Root of which is now fixt a Ceader Post marked with Sixteen Notches by Consent of Henry Dorman Dorman Jun.r and John Finch which pine or now pine Stump was proved by the Oath of White John Browne William Heath Sen.r to be the first bounder of a Tract of Land Called Deep Taken up and pattent by John Shipway and and that he this Deponant allways (heard) |
