Evidences on behalf of a Certain Henry Dorman Jun.r of the County af.d in Relation to the bounds of a tract of Land Called Deep or to the bounds of any other Lands on which the same may Depend &a Wee therefore Require you or any three or two of you at some time and place as to you or any three or two of you shall seem Convenient you meet on the af.d Land Called Deep (you first having taken your Oaths on the holy Evangelist of almighty God according to act of assembly in such Case in such case made and provided) And their Cause to Come before you or any three or two of you all such Evidences as shall be to you or any three or two of you Nominated by the said Complainant or Defendant if any and that you or any three or two of you Examine them upon their Corporall Oaths to be by you or any three or two of you Adm.rsd on the holy Evangelist of almighty God in the presence of the Complainant or Defendant if any touching the truth or Remembrance of their Knowledge or anything that may Relate to the cause af.d and that reduced the severall Depossitions into writing you send the same together with this our Commission under your or any three or two of you hands and seals to us to our County Court of somerset with all Convenient speed Wittness Rob.t King Gent Chief Justice of our said Court the third day of may in the nineteenth year of our Dominion Ann Dom One thousand seven hundred and thirty four On the Backside of the foregoing Commission it was Indorsed as followeth viz.d May the 14.th 1734 Came James Strawbridge and Thomas Brown before me the Subscriber and was quallified Agreeable to an act of assembly of ye province of Maryland duly and Impartially to Execute the within Commission as tis ^therein^ directed Henry Ballard Likewise to the same Commission were annexed the following Depositions The Deposition of Henry Dorman sen.r Aged sixty one years or there abouts being Sworn upon the holy Evangelist of Almighty God Deposeth & Saith that a Pine Stump Standing in the fork of two branches in the Edge of the Marsh near the high Land above Monokin Bridge where a Cedar post markt with sixteen Notches ^is^ set up by Consent of Henry Dorman Jun.r and John Finch that he the said Deponant heard it always Deem'd to be the first bounder of the tract of Land Called Deep and saith he saw it when it was a marked tree marked four ways and further the s.d Deponant saith that at the time that the above said pine tree (or now stump) was prov'd by John Brown and Will: Hath to be the first bounder of the above said Land Called Deep that the first Course from the said tree was run according to the patent by order of the jurie the Course and Distance therein Mentioned and the surveyer afterwards would not be Rul'd by the jurie any further but said as they ahd ^found him^ one Course he would find the rest himself and the said Deponant further saith that he has heard it often said that Edward Whilleer bought the Land of Tho.s Manlove and Let Samuel Worthington have the said Land for Edward Willeer understood that John Shipways Line Came over the branch and took away part of the said Land and further saith not Henry HD Dorman Sen.r Wee the Subscribers being duely Quallifed as appears His X Mark by Indorsement on a Commission to us Directed from somers.t County Court and having Comply'd with all the Requisits thereon Required by giving due notice Agreeable to act of Assembly do Certifie that the within Deposetion was taken and signed before us by Henry Dorman this 10.th day of June ann.o 1734 James Strawbridge Tho.s Browne (Peter) |
