178 here also &a Att which said next Court to witt the ninteenth day of march anno Dom One thousand Seven hundred and thirty three before the Justices thereof Cometh the afd Nicholas Hodgson by his attorney afd and the Sherriff of Somerset County sends not thereof the Writt therefore as before it is Commanded the Sherriff of the county afd that by the Oath of honest &a he diligently Enquire in form afd &a and the Inquisition which &a to the Justices of his Lordships County Court of Somerset to be held at Dividing Creek the third tuesday of June Next &a Under his Seal and the Seals &a he Send together with the Writt thereof to him directed &a and the Same Day is Given to the afd James herealso &a Att which said next Court to witt the eighteenth day of June anno Dom One thousand seven hundred and thirty four before at dividing Creek before the Justices of the Same Court Cometh the afd Nicholas Hodgson by his attorney afd and the sherriff of the Same County to witt Joshua Caldwell Gent returned a Certain Inquisition Indented and before him at the Court house in the County afd at dividing Creek on the seventeenth day of June one thousand seven hundred and thirty four taken by which it appears that the afd Nicholas has sustained damages by Occasion of the non performance of the promise and assumption afd further than his Costs and Charges by him about his suit in that part apposed to two pounds twelve shillings and three pence Currant money and for those Costs and Charges to One pound of tobacco Therefore it is Considered that the afd Nicholas Hodgson recover against the afd James Lindow his damages afd by the Inquisition afd in form afd found also one thousand & fifteen 1015 pounds of tobacco for his Costs and Charges afd to the same Nicholas by the Court hereof his assent of Increase adjudged which Certain damages in the whole do amount to two pounds twelve shill.s and three pence Currant money and pounds of tobacco & the afd defend.t in mercy &a
unto John Taylor of a plea that they render unto him Sixteen hundred pence Eight hundred in Tobacco and Eight hundred in Corn which to him they Owe and from him they Unjustly detaine &a And whereupon the Said John by Geo: Douglas his attorney says that whereas the afd Tho.s and Alex.d on the first Day of March Ann Dom One thousand Seven hundred & thirty Two at Somerset County Within the Jurisdiction of this Court by their Certain Writing Obligatory had Granted themselves to be bound to the afd John in the afd Sum of Sixteen hundred pence Eight hundred in tob.o and Eight hundred in Corn to be paid unto the afd John when thereof afterwards they Should be required Nevertheless the Said Tho.s and Alex.d altho' often required the afd Sixteen hundred pence to the afd John hath not paid but the Same to him to pay altogether have refused and Still doth refuse to the Damage of the said John of Three thousand two hundred pence and thereof he brings Suit and brings hereinto Court the Writing Obligatory afd which the Debt afd in form afd doth testifie whose date is the same day & year afd &a pledges &a John Doe & R Roe and |
