178 hundred and thirty two Came againe the said Nicholas Hodgson and thereupon he puts in his place & Stead a Certain William Beckingham attorney at Law to prosecute for him in the premises afd against the said James Lindow, Likewise Came the said James Lindow by his attorney afd And thereupon the same Jame Lindow prays further Leave to Imparle hereuntill next Court and he hath it and the Same day is Given to the afd Nicholas here also &a Att which said next Court to witt the ninteenth day of June anno Dom One thousand seven hundred and thirty three Came againe as well the afd Nicholas Hodgson by s as the afd James Lindow by their attorneys afd and thereupon the said Nicholas by his said attorney prays that the afd James to his declaration afd may answer whereupon the attorney of the afd James says that he is not Informed by the same James his Clyant of any answer for the same James to the afd Nicholas in the plea afd to be given and nothing Else thereof says by which the same Nicholas Remaineth against the afd James thereof undefended for that the same Nicholas his damages by Occasion of the non performance of the promise and assumption afd against the afd James Ought to recover but because it is not known what damages the afd Nicholas has sustained by Occasion of the non performance of the promise and assumption afd It is Commanded the sherriff of Somerset that by the Oath of honest and Lawfull men of his bailywick he diligently Inquire what damages the same Nicholas has sustained as well by occasion of the non performance of the promise and assumption afd as for his Costs and Charges by him about his Suit in that part apposed and the Inquisition which thereupon he should take he make appear to the Justices of his Lordships County Court of Somerset to be held at dividing Creek in the County afd the third tuesday of AUgust next under his Seal and the Seals of those by whose Oath he should make that same Inquisition he send together with the writt thereof to him directed &a and the Same day is Given to the afd James here also &a Att which said next Court witt the twenty first day of August anno Dom One thousand Seven hundred and thirty three before the Justices thereof Cometh the afd Nicholas Hodgson by his attorney afd and the sherriff of Somerset County sends not thereof the writt therefore as before it is Commanded the sherriffe of Somerset County that by the Oath of honest &a he diligently Enquire in form afd &a and the Inquisition which &a to the Justices of his Lordships County Court of Somerset to be held at dividing Creek the third tuesday of November next &a under his Seal and the Seals &a he sent together with the writt thereof to him directed &a and the same day is given to the afd James here also &a Att Which said next Court to witt the twentieth day of November anno Dom One thousand seven hundred and thirty three before the Justices thereof Cometh the afd Nicholas Hodgson by his attorney afd and the sherriff of Somerset County sends not thereof the writt therefore as before it is Commanded the sherriff of the County afd that by the Oath of honest &a he diligently Enquire in form afd &a and the Inquisition which &a to the Justices of his Lordships County Court of Somerset to be held at dividing Creek the third tuesday of March next &a under his seal and the Seals &a he send together with the writt thereof to him directed &a and the same day is given to the afd James here |
