165 Civilly Quietly & peaceably behaved & Demeaned himself as well Towards all his Neighbours as other faithfull Liege Subjects of Our Lord the King and no Uncivill behaviour breach of the peace assault & battery or any such Unlawfull Crime by the whole Time aforesaid Ever Comitted & perpetrated but from the Same or any suspition of the Like Crimes by the whole time aforesd hath free Clear & Wholy Unsuspected & Unattainted remained and hath kept & Conserved himself & all his Goods & Chattles free & Clear & in No wise subject to the Rigour of the Law for such Like Offences made & provided Nevertheless the said Patrick being not Ignorant of the prmisses but plotting & Malitiously Intending the said Edward most Unjustly to Grieve and his Good Name fame Creditt & Esteem aforesd to Destroy & him the said Edward into the hatred & Infamy of his Neighbours & other faithfull Liege Subjects of Our Lord the King now to Induce & Innocently to Cause him to be brought into Danger of Making fine to the Right Honrble the Lord propry of this province as the Law in Such Cases Directs at a Court of the Said Right Honrble the Lord propry held for Somerset County aforesd at Dividing Creek in the same County the third Tuesday of June Last past before the Worshipfull M.r William Fassit & his Associates his Lordships Justices the peace in the Said County to keep as also Divers Felonys Trespasses & Other Offences in the said County Comitted to hear & Determine assigned falsely & Malitiously and Without any True or Lawfull Cause him the Said Edward upon Evidence Given by him the said Patrick ag.t him the said Edward the Twenty fourth Day of Janry Ann Dom One thousand Seven hundred & thirty Two with force & arms at the County of Somerset aforesd and Within the Jurisdiction of this Court in & Upon him the Said Patrick in the peace of God and of the aforesd Lord prop.ry then and there being an Assault Did make and him then & there Did beat Wound and Evilly Intreat So that of his Life it was Greatly Dispaired and Other Harms to him then and there offered to the Grievous Damage of him the said Patrick and against the peace of the Right Honrble the Lord propry &a Whereupon the said Patrick the day & year aforesd at the County aforesd him the Said Edward for the Cause aforesd Did Cause to be taken and in the prison of the Right Honrble the Lord Prop.ry at Dividing Creek in the County aforesd to be kept Untill he the said Edward at the Court aforesd before the Justices aforesd According to the Laws & Customs of this province & the Laws Statutes & reasonable Customs as England Used & Practised in this province was of the same Lawfully Acquitted by prtext of which prmises the said Edward not only in his Good name fame Creditt & Repute aforesd is Very much hurt & Made Worse and in his body Very Much Disquieted but also sundry sums of Tobacco for the purgation Discharge Declaration & Defence of his Innocency in that part to Expend & Lay Out was forced & Compelled To the Damage of the Said Edward of Five thousand pounds of Tobacco And thereupon he brings suite &a pledges &a John Doe & R.d Roe And the afd Patrick Daley by W.m Beckingham his attorney Comes and defends the force and Injury when &a and prays Leave thereof to Imparle hereuntill next Court and he hath it and the same day is given |
