165 December 24th 1733 Came Benjamin Sharpe and made Oath on the holy Evangels of Almighty God that the above Account is Just and True as it their Stands Stated and that he hath not Directly or Indirectly Received (to his knowledge) any part or pcell of the above sum or any security or Satisfaction for the Same which account is proved the Day above agreeable to act of assembly before RKing And the afd John ^Purnall^ by Francis Allen his attorney Comes and Defends 1731 the force and Injury when and prays Leave thereof to Imparle Hereuntill Next Court and he hath it and the Same Day is Given to the afd Benjamin herealso &a Att which said Next Court to Witt the Ninteenth Day of March Ann Dom One thousand Seven hundred and thirty three Came againe as Well the afd Benjamin Sharpe as the afd John Purnall by their attorneys afd and Whereupon the Said John Purnall prays further Leave thereof to Imparle hereuntill Next Court and he hath it and the same Day is Given to the afd Benjamin herealso &a Att which said next Court to witt the eighteenth day of June ^ann Dom One thousand seven hundred & thirty four^ Came againe as well the afd Benjamin Sharp as the afd John Purnall by their attorneys afd and whereupon the afd John Purnall as before defends the force and Injury when &a and says that he did not assume upon himselfe in manner and form as the afd Benjamin above against him hath Complained and of this he puts himselfe upon the County &a and the plft in like manner And afterwards to witt the same day and Year Last above mentioned the same Benjamin Sharpe By his attorney afd Cometh here into Court and Confesseth that he will noe furthoe prosecute against the afd defend.t in the plea afd &a Therefore it is Considered that the afd Benjamin Sharp take nothing by his writt and declaration afd but be in mercy for his false Clamour and that the said John Purnall Goe thereof without day and further it is Considered that the afd John Purnall Recover against the afd 308 Benjamin Sharp Three hundred & Eight pounds of tobacco for his Costs and Charges by him about his defence in that part sustained to the same John Purnall by the Court here according to the form of the statute in Such Cases Lately made and provided of his assent adjudged & that the afd John have thereof Execution &a
