164 Thomas Newbold, John Roach Jos Gray John White, Parker Selby Michael Godwin John Webb Robert Collier James Smith Jonathan Bounds and Angello Attkinson who to Say the truth of the premisses being duely Elected tryed and Sworn upon their Oath doe say that the afd Robert Downs did not assume upon himselfe in manner and form as the afd Timothy Handson above against him hath Complained &a Therefore it is Considered that the afd Timothy Handson take nothing by his writt and declaration afd but be in Mercy for his falce Clamour and that the afd Robert Downs Go thereof without day and further it is Considered by the Court here that the afd Robert Downs Recover against the afd Timothy Handson 618 six hundred & Eighteen pounds of tobacco for his Costs and Charges by him about his defence in that part Sustained to the Same Robert Downs by the Court here according to the form of the Statute in Such Case Lately made and provided of his assent adjudged and that the afd Robert have thereof Exn &a
twenty at Somerset County afd within the Jurisdiction of this Court was Indebted unto the Same Benjamin in the Sum of fourteen pounds three shillings Currant money of maryland for Sundry properly Chargable in an account as by an account hereinto Court brought may appear and being so thereof Indebted the day and year afd at the place afd and within the Jurisdiction afd in Consideration thereof upon himselfe did assume and to the said Benjamin then and there did faithfully promise that he the said John the afd Fourteen pounds three shillings to the said Benjamin when he should be thereunto requested he would well and faithfully pay and Content Nevertheless the said John his promise and assumption aforesaid in form aforesaid made Nothing regarding but Plotting and fraudulently Intending the Said Benjamin in that part Craftily and Subtilly to Deceive and Defraud the Said Fourteen pounds three Shillings to the Said Benjamin (altho' the same to do the said John by the said Benjamin on the aforesaid Seventh Day of April in the Year aforesaid and often afterwards at the County aforesaid he was thereunto requested) hath not paid or Contented but the same to him hitherto to pay or Content hath refused and Still Doth Refuse & Deny Wherefore the said Benjamin Saith he is worse and hath Damage to the Value of Thirty pounds Current Money aforesaid and thereupon he brings Suit &a pledges &a Jno Doe & Ri Roe
