164 made in No Sort regarding but minding & fraudulently Intending the Same Timothy in this part Craftilly and Subtilly to Deceive and Defraud the afd seven pounds thirteen shillings or any penny thereof to the same Timothy hath Not paid or him for the Same in any sort Contented altho' to do the same the afd Robert afterwards to Wit the first Day of July in the Year and at the place afd and often afterwards by the same Timothy was required but that to him hitherto to pay or him for the same in any sort to Content the same Robert altogether hath Refused and Still Doth refuse to the Damage of the same Timothy Fifteen pounds six shillings Current Money and thereof he brings suit &a pledges &a Jno Doe R.d Roe Whereupon the said Robert Downs in his Own proper person Came hereinto Court and thereupon the said Robert Downs at the prayer of the afd Timothy Handson by his Attorney afd is adjudged to Give speciall Bail to the Action afd Thereupon a Certain James Martin of Somerset County Gent present here in Court in his proper person Under Takes for the said Robert Downs that if in Case the said Timothy Handson should Recover Judgment in the plea afd against the said Robert Downs or that the said Robert Downs should be therein Convict that then he the Said Robert Downs should pay the Condemnation of the Court thereupon or render his body to the Custody of the sherriff of Somerset County in satisfaction thereof or that he the said James Martin Will do the Same for him &a Thereupon the said Robert Downs by George Douglas his attorney Comes and defends the force and Injury when &a and prays Leave thereof to Imparle here untill next Court and he hath it and the same day is given to the afd Timothy herealso &a Att which said next Court to witt the Ninteenth day of March anno Dom One thousand seven hundred and thirty three Came againe as well the afd Timothy Handson as the afd Robert Downs by their attorneys afd and whereupon the afd Robert prays further Leave thereof to Imparle hereuntill next Court and he hath it and the same day is given to the afd Timothy here also &a Att which said next Court to witt the Eighteenth day of June anno Dom One thousand Seven hundred & thirty four Came againe as well the afd Rober Timothy Handson as the afd Robert Downs by their attorneys afd and whereupon the said Robert Downs as before defends the force and Injury when &a and Says that he hath not assumed upon himselfe in manner and form as the said Timothy above against him hath Complained and of this he putts himselfe upon the Country and the afd Timothy in Like manner Thereupon it is Commanded the sherriff of Somerset County that Immediately he should Cause to Come here before the Justices of his Lordships County Court of Somerset now in Court sitting at dividing Creek in the County afd twelve &a by whom &a who neither &a to recognize &a because as well &a and afterwards Immediately Came thereof the Jury &a and the Jurors of that Same Jury by Joshua Caldwell Gent sherriff of the County afd to this Impannelled being Called Came to witt Adam Spence Jun.r Thomas |
