                                   Robert Downs late of Somerset County Joyner was attached to answer
unto TImothy Handson of a plea of trespass upon the Case &a
And whereupon the said Timothy by William Beckingham his attorney Complaines that
whereas a Certain William Maxwell after the first day of May in the Year of our Lord seventeen hundred and five to witt
the twenty fifth day of July in the Year of Our Lord Seventeen hundred & Twenty Nine at Somerset
County made his Certain Note in Writing Called a Promisary note with his proper hand thereto
subscribed bearing Date the Same Day and Year Last Mentioned and by the Same Note promised to
pay to the afd Robert Downs hi heirs or Assigns seven pounds thirteen Shillings on Demand after
the Date of the Same Note  And whereas also afterwards to Wit the Eighth Day of May in the Year
of Our Lord seventeen hundred & thirty at Somerset County afd the afd Robert Downs (the afd Seven
pounds thirteen Shillings in the Note afd Mentioned in No sort paid or satisfied being) by his
Certain Indorsement with his proper hand upon that Note Indorsed ordered and Appointed the
Contents of the Same Note to Wit the afd seven pounds thirteen shillings to be paid to the said
Timothy  And the afd Timothy in fact saith that after the Indorsement and Order afd so as afd
Made to Wit the first Day of June in the Year of Our Lord Seventeen hundred and thirty afd at
Somerset County afd he the Same Timothy Did shew the Note afd and the Indorsement afd upon the
Same Made to the afd William Maxwell and then and there required the afd William Maxwell
to pay the Contents of the Same Note to Wit the afd seven pounds thirteen shillings in the same
Mentioned According to the Tenor of the Note and Indorsement afd to him the said Timothy
Nevertheless the afd William Maxwell the afd seven pounds thirteen shillings or any part
thereof to the same Timothy hath not paid but that to him hitherto to pay altogether hath
Refused Whereof the same Timothy afterwards to Wit the same Day and Year Last Mentioned at
the County af.d to the afd Robert Did Give Notice by reason whereof as also by force of the statute
in such Case made and provided the afd Robert became  And is Chargeable to pay to the afd Timothy
the afd seven pounds thirteen shillings in the same Note Mentioned and so therewith being
Chargeable the same Robert in Consideration thereof afterwards to Wit the same Day Year
and place Last Mentioned upon himself Did Assume and to the same Timothy then and there
faithfully Did promise that he the same Robert the same seven pounds thirteen shillings
to the same Timothy when thereof afterwards he should be required well and faithfully would
pay and Content  Nevertheless the aforesd Robert his promise and assumption afd in form afd
