163 thereof afterwards to witt the same day and Year last above mentioned at Somerset County afd within the Jurisdiction afd upon himselfe did assume and to the said William then and there did promise to pay to the said William the afd six pounds six shillings and six pence according tot he tenour of the same note and of the Indorsment afd Nevertheless the said Joseph his promise and assumption afd in form afd made nothing regarding but plotting and fraudulently intending the said William in that part Craftilly and Subtilly to deceive and defraud the said Six pounds Six shillings and Six pence to the said Willm according to the tenour of the said note and Indorsment afd hath not paid or Contented altho' the same to do the said Joseph by the said William on the afd second day of august in the Year Last afd and Often afterwards at Somerset County afd he was thereunto requested but the Same unto him hitherto to pay hath refused and still doth refuse and deny to the damage of the said William of twelve pounds thirteen shillings Currant money of Maryland and thereupon he brings suite &a Pledges de p John Doe R Roe Whereupon the said Joseph Hall in his Own proper person Came hereinto Court and thereupon the said Joseph Hall at the prayer of the afd William Burton by his attorney afd is adjudged to give Speciall Bail to the action afd Thereupon a Certain John Murray of Somerset County felt maker present here in Court in his proper person undertakes for the said Joseph Hall that if in Case the said William Burton should recover Judgment in the plea afd against the said Joseph Hall or that the said Joseph Hall should be therein Convict that then he the said Joseph Hall should pay the Condemnation of the Court thereupon or render his body to the Custody of the sherriff of Somerset County in satisfaction thereof or that he the said John Murray will doe the Same for him &a Thereupon the said Joseph Hall by George Douglas his Attorney Comes & Defends the force and Injury When &a and prays Leave thereof to Imparle Hereuntill Next Court and he hath it and the same Day is Given to the afd William herealso &a Att which said Next Court to WItt the Ninteenth Day of March Ann Dom One Thousand seven hundred and thirty three Came Againe as well the afd WIlliam Burton as the afd Joseph Hall by their Attorneys afd and Whereupon the sd Joseph Hall prays further Leave thereof to Imparle hereuntill next Court and he hath it and the same Day is Given to the afd William herealso &a Att which said Next Court to witt the Eighteenth Day of June Ann Dom One thousand seven hundred and thirty four Came Againe as Well the afd William Burton as the afd Joseph Hall by their Attorneys afd and whereupon the same Joseph says that he Cannot gainsay the action afd of the afd William nor Can he Say but that he did assume upon himselfe in manner and form as the afd William above against him hath Complained and as to the damage of the same William by him by Occasion of the premisses in that part Sustained the same Joseph saith and Confesseth that the afd William hath sustained damages by Occasion of the premisses further than his Costs and Charges by him about his suit in that part apposed to six pounds six shillings and six pence Currant money and not more and because the afd William denys not this but the same allegation Confesseth to be true |
