162 who to Say the truth of the premisses being duely elected tryed and Sworn upon their Oath doe Say that the afd John Bishop did assume upon himselfe in manner and form as the afd John Purnall above against him hath Complained and assesses the damages of the same John Purnall by him by occasion of the non performance of the promise and assumption afd in that part Sustained beyond his Costs and Charges by him about his Suit in that part apposed to Eight hundred ^pounds^ part apposed and for those Costs and Charges to One pound of tobacco &a Therefore it is Considered that the afd John Purnall recover against the afd John Bishop his damages afd by the Jurors afd in form afd assessed as also Six hundred & Seventy Seven 677 pounds of tobacco for his Costs and Charges to the Same John Purnall by the Court here of his assent of Increase adjudged which Certain damages in the whole do amount to pounds of tobacco and the afd deft in mercy &a
the said Joseph after the first day of may anno Dom seventeen hundred and five to witt on the twenty fifth day of July Seventeen hundred and thirty at Somerset County within the Jurisdiction of this Court made his Certain note in Writing Called a promissory Note with his proper hand thereunto subscribed bearing Date the Same Day and Year Last Abovesd ^and^ the Said Note to a Certain Richard Poultney Delivered by Which Said Note the Said Joseph promised to pay on Demand to the aforesd Richard or Order the Just Sum of seven pounds Twelve Shillings & Tenn pence for Value Received and the aforesd Richard afterwards to Witt on the Second Day of August Ann Dom seventeen hundred & thirty one having before Received from the said Joseph one pound six & four pence pcell of the seven pounds Twelve Shillings & Tenn pence in the Note aforesd Mentioned six pounds six shillings & six pence residue thereof Not being in any sort paid or any Wise satisfied by his Certain Indorsement upon the Said Note made and Written and With the proper hand of them the Said Richard subscribed Did Order & Appoint the said six pounds six shillings & six pence residue of the aforesd seven pounds Twelve shillings & tenn pence in the Note aforesd Mentioned to be paid to the said William and Afterwards to Witt the same Day & Year Last Mentioned the said Joseph at Somerset County aforesd within the Jurisdiction aforesd by the hands of the aforesd William of the Indorsement aforesd had Notice and by reason of the premisses as also by force of the Statute in such Cases Lately made and provided the said Joseph became Chargable to pay to the said William the afd six pounds six shillings and six pence residue of the afd seven pounds twelve shillings and ten pence in the note afd mentioned then in arrear due owing and unpaid according to the form ^&^ Effect of the said note and the Indorsment afd thereupon so as afd made and so being Chargable the said Joseph in Consideration |
