(162) part Craftilly & Subtilly to Deceive & Defraud the Mare aforesd to the Said John Purnell hath not redelivered nor any Horse in Excange for the said Mare nor hath he paid and satisfied to the said John Purnell any Money or Tobacco arrising upon the sale of the said Mare altho' the same to do the said John Bishop on the first Day of May Anno Dom Seventeen hundred & thirty three & often afterwards at Somerset County aforesd WIthin the Jur aforesd he was by the said John Purnell thereunto requested but the same to do hath hitherto altogether refused and Still Doth refuse & Deny To the Damage of the said John Purnell of Two thousand pounds of Tobacco and thereupon he brings suite &a pledges &a John Doe & R Roe And the afd John Bishop by William Beckingham his Attorney Comes and Defends the force and Injury when &a and prays Leave thereof to Imparle hereuntill next Court and he he hath it and the same Day is Given to the afd John Purnall herealso &a Att which said Next Court to Witt the Twenty first Day of August Ann Dom One thousand Seven hundred and thirty three Came againe as well the afd John Purnall as the afd John Bishop by their attorneys afd and Thereupon the said John Bishop prays further Leave thereof to Imparle Hereuntill next Court and he hath it and the Same Day is Given to the afd John Purnall herealso &a Att which Said next Court to witt the Twentieth Day of November Ann Dom One thousand Seven hundred and thirty three Came Againe as well the afd John Purnall as the afd John Bishop by their attorneys afd and thereupon the said ^John^ Bishop prays further Leave thereof to Imparle hereuntill Next Court and he hath it and the same day is Given to the afd John Purnall herealso &a Att Which Said Next Court to Witt the Ninteenth Day of March Ann Dom One One thousand Seven hundred and thirty Three Came againe as well the afd John Purnall as the afd John Bishop by their Attorneys afd and thereupon thereupon the said John Bishop prays further LEave thereof to Imparle hereuntill Next Court and he hath it and the Same Day is Given to the afd John Purnall herealso &a Att which said Next Court to Witt the Eighteenth Day of June Ann Dom One Thousand seven hundred and thirty four Came Againe as Well the afd John Purnall as the afd John Bishop by their attorneys fd ^and thereupon the said John Bishop as before defends the force & Injury when &a^ and saith that he hath not assumed upon himselfe in manner and form as the afd John Purnall above against him hath Complaines and of this he puts himselfe upon the Country and the plft in Like manner Thereupon it is Commanded the sherriff of Somerset County that Immediately that he should Cause to Come here before the Justices of his Lordships County Court of Somerset now in Court Sitting at dividing Creek in the County afd twelve &a by whom &a and who neither &a to recognize &a because as well &a and afterwards Immediately Came thereof the Jury &a and the Jurors of that same Jury by Joshua Caldwell Gent sherriff of the County afd to this Impannelled being Called Came to witt John Donelson, Adam Spence Jun.r John Roach Jos: Gray, John White Hutton Hill Michael Godwin John Webb Robt Collier, Jams Smith Jonathan Bounds and Angello Atkinson who |
