161 the afd Plft may reply to the plea afd of her the same deft whereupon it is Said to the Same Rob.t by the Court here that he reply to the plea afd and Enter the Issue in the afd plea and afterwards being the same term before the Justices thereof at dividing Creek in Somerset County ^afd^ the afd Robert altho' Solemnly Called Cometh not nor to the plea of the afd defend.t replyeth nor is his writt ^and declaration^ afd against the afd Susannah further prosecuted &a Therefore it is Considered by the Court here that the afd Robert Gordon take nothing by his writt and declaration afd but that he and his pledges of prosecuting to witt John Doe and Richard Roe be in mercy and the afd Susannah Goe thereof without day &a and further it is Considered that the afd Susannah Wordie Executrix of the afd Alexd Wordie Recover against the 322 the afd Robert Gordon three hundred & Twenty Two pounds of tobacco for her 322 Costs and Charges by her about her defence in that part Sustained to the same deft by the Court here according to the form of the Statute in Such Case thereof made and provided adjudged and the same Susannah have thereof Execution &a Memorand.m the Security for Costs should have been Entered at the End of the * probat of the acco.t but was Omitted & Entered here as followeth Whereupon the said Susannah Wordie Exrx as afd by George Douglas her attorney Comes and prays that the afd Robert Gordon may give Security for Costs in Case nonsuit be Obtained against him in the plea afd which is by the Court Granted thereupon a Certain Francis Allen of Somerset County Gent present herein Court in his proper person undertakes for the said Robert Gordon that in Case he Nonsuited in the plea afd or Otherwise Legally Cast that then ^her^ the said Robert Gordon shall pay the Condemnation of the Court and all Costs accrewing thereon to the said Susannah Wordie or that he the said Francis Allen will do it for him &a
