16 Occasion of the Non performance of the promise and assumption afd as for her Costs and Charges by her about the Suit in that part apposed and the Inquisition which thereupon he should take he make appear to the Justices of his Lordships County Court of Somerset to be held at dividing Creek in the County afd the third tuesday of march next under his seal and the Seals of them by whose Oath the Same Inquisition is taken he send together with the writt thereof to him directed and the Same day is Given to the afd James there also &c Att which said third tuesday of March to witt the twentieth day of the Same month anno Dom One thousand Seven hundred and thirty two before his Lordships Justices of Somerset County Court then held at dividing Creek in the County afd Came the afd Sarah by her attorney afd and the Same sheriffe sends not thereof the writt Therefore as before it is Commanded the same sher that by the Oath of Honest and Lawfull men of his County he diligently Enquire in form afd &.c and the Inquisition which thereupon he should take to his Lordships Justices of the County Court of Somerset to be held at dividing Creek in the County in the County afd the third tuesday of June Next under his seal and the Seals of them ^&c^ he send togethere with the writt to him thereof directed &.c and the same day is given to the Same James ^here^ also Att which said third Tuesday of June do with the Nineteenth day of the same month ann.o Dom One thousand seven hundred and thirty three at dividing Creek in the County afd Came the afd Sarah Stewart by her attorney afd and the Sheriffe to witt Joshua Caldwell Gent Returned a Certain Inquisition taken and Indented before him at the Court house in Somerset County at dividing Creek afd the Ninth day of June Instant by the Oath of Honest and Lawfull men of his County by which it appears that the afd Sarah has Sustained damages by Occasion afd further than her Costs and Charges by her & about her Suit in that part apposed to seven pounds Eighteen shillings and Nine pence three farthings Currant money of Maryl.d and for those Costs and Charges to one pounds of tobacco Therefore it is Considered that the afd Sarah Stewart admrx of the Same John Stewart Recover against the afd James Lindow her damages afd by the Inquisition afd in form afd appears as also 1215 Twelve hundred and fifteen pounds of tobacco for her Costs and Charges afd to the same Sarah by the Court hereof her assent of Increase adjudged which Certain damages in the whole do amount to Seven pounds Eighteen shillings and nine pence three farthings Currant money of Maryland and Twelve hundred and fifteen pounds of tobacco and the afd James in Mercy &c
And Whereupon the same Edw.d North by George Dashiell his Attorney says that Whereas the aforesaid Edw.d in Novemb.r Court to Witt the Twenty first Day of the same Month Anno Dom One thousand seven hundred and Twenty one |
