15 damages the afd John has Sustained by Occasion of the Non performance of the promise and assumption afd Command is given to the sheriffe of Somerset County that by the Oath of Honest and Lawfull men of his County he diligently Inquire what damages the afd John hath Sustained as well by Occasion of the non performance of the promise and assumption afd as for his Costs and Charges by him about his Suit in that part apposed and the Inquisition which thereupon he should take he make appear to the Justices of his Lordships County Court of Somerset to be held at dividing Creek the third tuesday of November next under his seal and the seals of them by whose Oath the same Inquisition is taken he send together with the writt thereof to him directed and the same day is given to the afd James here also &.c And that he should then and there have the writt for that purpose to him to be directed but before the Issuing of the said Writt to Witt on the Twentieth day of August one thousand Seven hundred and thirty two the said John at the County aforesaid died Intestate as it is said after whose death Administration of all and Singular the Goods and Chattles Rights and Credits which were of the aforesaid John at the time of his Death to sarah Stewart Widdow of the aforesaid John to witt on the thirty first Day August Anno Dom seventeen hundred and thirty two by David Wilson Deputy Commis.rs of Som.st County in Due form of Law was Comitted as by the Insinuation of the said Sarah we are Given to Understand by Reason whereof and by force and Virtue of the Statute in such Case lately made and provided action accrewed to the said Sarah to prosecute the Suit afs.d and to have Damages thereupon assessed in order to the obtaining finall Judgment and Execution as well for the Damages afs.d as all Costs and Charges about the afores.d Suit opposed Thereupon it was Command'd the said Sherr that by Honest and Lawfull men of his bailywick he should make known unto the afs.d James Lindow that he should be and appear before our Justices of our County Court afs.d to be held at Dividing Creek the third Tuesday of Novemb.r then Next to shew Cause if that any thing for himself he had or to say knoweth wherefore the said Sarah should not have her writt of Inquiry of Damages on the Recovery afs.d according to the form of the statute in such Case lately made and provided at which Day Came the afs.d Sarah by Francis Allen her Attorney and the said Sher at that same day Returned to his ^Lordship^ Justices at Dividing Creek afs.d that he had made known unto the aforesaid James that he ^Might^ be and appear before the same Justices at the day and place aforesaid and the said James so forewarned by William Beckingham his attorney Came and says that he Cannot Gainsay but that the afs.d Sarah ought to have her writt of Inquiry of Damages against the aforesaid James on the Recovery afs.d according to the form of the Statute in such Case Lately made and provided Thereupon Command is Given to the sher of Somerset County that by the oath of honest and Lawfull men of his County he diligently Enquire what damages the the afd Sarah has Sustained as well ^by Occasion |
