1734 159 Samuel Pickering towards Satisfying unto him his damages and all Costs accrewing by means of the attachment afd &a thereupon William Hudson of Somerset County planter present here in Court in his proper ^person^ undertakes for the said Dennis Hudson According to act of assembly that in Case the said Samuel Pickering do at any time within a year and a day appear and make all or any part of the said Dennis Hudsons Claim against him appear to be Satisfied or Otherwise to have been undue before the Laying of his attachment that then the said Dennis Hudson shall make restitution unto him the said Samuel Pickering of all or such part thereof as shall be made appear to be undue &a or that he the said William Hudson will do it for him &a Therefore it is Considered by the Justices here that the afd Sum of Seven pounds ten shillings Curr money and Five hundred pounds of tobacco so as afd attached be Condemned in the hands of the afd Archibald MccNeal as of the rights and Creditts of the said Samuel Pickering towards satisfying unto the said Dennis Hudson his damages and Costs and that the said Dennis have thereof Execution &a
Townsend Late of Somerset County Joyner if they shall be found in your bailywick to the Value of Four pounds Curr.t Money of Maryland and five hundred pounds of Tobacco and when you have the Same Attached or Any part thereof the Same in Your Custody safe keep so that You have the Same before Our Justices of Our County Court of Somerset to be held at Dividing Creek that third Tuesday of June Next then and there to be Condemned According to Act of Assembly to and for the use of a Certain Adam Spence Jun.r unless the said Robert Townsend by himselfe or his attorney shall appear and answer unto the said Adam Spence in a plea of trespass upon the Case &a according to Law and that by good and Lawfull men of your Bailywick you make known unto the persons or persons in whose hands you make the same attachment that ^he^ she or they be and appear before Our Justices of Our County Court to be held as afd to shew Cause if any she or they have why the same goods Chattells Rights or Creditts so attached in his her or their hands ought not to be Condemned and Execution thereof had and made according to act of assembly in Such Case made and provided if to him her or them it shall seem mete and how you shall Execute this writt that your make known unto Our said Justices at the day and place afd and have you then and there this Writt Wittness Robert King Gent Chiefe Justice of Our said Court the the third day of may anno Dom One thousand seven hundred & thirty four Att which said third tuesday of June to witt the Eighteenth day of the same month anno Dom One thousand Seven hundred and thirty four being the day of the return of the said Writt Cometh the said Adam Spence Jun.r by Robt Jenckins Henry his attorney and the sher of Somerset County to whom the foregoing writt was directed ^likewise^ Comes and makes return thereof to the Court here Endorsed in these words following |
