1734 157 Indenture and Records of the County afd &a Therefore it is Considered by the Justices here that the afd Laurence Eddes and Ann his wife Recover against the afd Thomas Fletcher their damages by Occasion of the premisses afd to three hundred pounds of tobacco as also 237 pounds of tobacco for their Costs and Charges by them in their in this behalfe Laid Out and Expended by the Court here adjudged &a
to be held at Dividing Creek the third Tuesday of June then Next to Answer Unto William Clayland of a plea that he render unto him the Sum of quantity of Two thousand five hundred pounds of Good Sound Merchantable Leaf Tobacco which unto him he Oweth and Unjustly Detaineth &a and that thereof he should not faile &a And the said William Clayland by William Goldsborough his attorney declared against the said Patrick Connelly in the plea afd as followeth vizt Somerset County ss.t Patrick Connelly late of Somerset County in the province of Maryland Hatter Otherwise Called Patrick Connelly of Somerset County in the province of Maryland Hatter was somoned to answer unto William Clayland of a plea that he Render unto him the sum or quantity of two thousand five hundred pounds of good sound merchantable Leafe tobacco which unto him he Oweth and unjustly detaineth &a And whereupon the same William Clayland by William Goldsborough his attorney say that whereupon the afd Patrick the twelfth day of December which was in the Year of Our Lord God seventeen hundred and thirty three at Somerset County afd by his Certain Writing Obligatory had Granted himselfe to be bound unto the afd William Clayland in the afd sum of Quantity of Two thousand five hundred pounds of Good sound Merchantable Leafe Tobacco to be paid unto the same William Clayland when thereof afterward he should be required Nevertheless the afd Patrick altho' often required the afd Two thousand five hundred pounds of Good Sound Merchantable Leafe Tobacco unto the same William Clayland hath not paid but that unto him hitherto to pay altogether hath refused and still Doth refuse to the Damage of the same William Clayland five Thousand pounds of Like Tobacco and thereupon he brings suit &a and doth bring hereinto Court the Writing Obligatory afd which the Debt afd in Form afd doth Testify the Date whereof is the same Day and year afd &a Pledges &a John Doe & Richard Roe A Coppy of the Foregoing declaration was made and Sent to be served on the deft with the writt in |
