152 And their Successors for the time being as also the Inhabitants of the Same County of and from all Costs Charges troubles and burthens whatsoever for and by reason of the birth maintainance Nourishing and bringing up of the Child afd and from all Suits troubles Charges and demands whatsoever touching or Concerning of the Same &a
within the Jurisdiction of this Court did Committ fornication with a Certain person to the Jurors afd unknown and did permitt the Same unknown person then and there to have Carnall knowledge of her body and to begett then and there a bastard Child on the body of her the same Eliz.a to the high displeasure of almighty God to the evill Example of all Others in Such Case Offending Contrary to the peace of the said Lord proprietary that now is his good rule and Government and against the form of the act of assembly in Such Case Lately made and provided &a Test Joshua Merrill On the back side of the foregoing bill of Indictment it was thus Endorsed in these words following Vizt Billa Vera Samuel Wilson Foreman Thereupon Command was given to the Sherriff of Somerset County that he should take the said Elizabeth Fittne if &a to answer &a and afterwards to witt the Eighteenth day of June anno Dom one thousand Seven hundred and thirty four before the Justices of his Lordships County Court of Somerset here held at dividing Creek in and for the County afd Came the afd Eliz.a Fittne and in her proper person and being by the Sherriff set to the bar is thereupon Instantly demanded how she and would acquitt herselfe of the premisses afd says that of the premisses afd she is Guilty thereof and makes Oath that a Certain Samuel Atkinson is the father of the Child she stands Indicted for and is willing to pay her fine for the fact afd &a whereupon all and Singular the premisses afd being seen heard and fully understood It is Considered by the Court here that the afd Eliz.a Fittne pay to his Lordship the Lord proprietary for her fine by the Court hereupon her Imposed for and by Occasion of the premisses afd whereof in form afd she is Convict thirty shillings Currant money to the Use of Somerset County afd and that the Same Elizabeth Fittne be taken to satisfie the fine afd whereupon the said Eliz.a Fittne ^is ordered to^ give Security for the payment of the Severall officers their Fees due upon the Indictment afd &a Whereupon a Certain Littleton Townsend of Somerset County planter present here in Court acknowledged himselfe to be Indebted unto his Lordship the Lord proprietary in five pounds sterling to be levied &a In Case ^he^ the Said Littleton Townsend doth not pay unto the ^severall^ Officers of Somerset County Court their fees due by Occasion of the premisses afd upon the Indictment afd &a |
