151 servant of Capt John MccClester and of her body then and there had Carnall Knowledge and a bastard Child on the body of her the same Mary then and there did begett to the high displeasure of almighty God to the Evill Example of all Others in such ^Cases^ Offending Contrary to the peace of the said Lord proprietary that now is his good rule and Government and against the form of the act of assembly in Such Case lately made and provided &a on the back side of the foregoing bill of Indictment it was thus Endorsed vizt Billa Vera Sam Wilson foreman Whereupon Command was given to the sherriff of Somerset County that he should take the said John Hopkins Jun.r if &a to answer &a and afterwards here to witt the Eighteenth day of June ann.o Dom One thousand seven hundred and thirty four before the Justices of his Lordships County Court of Somerset here held at dividing Creek in and for the County afd Came the said John Hopkins Jun.r in his proper person and being Instantly demanded how he would acquitt himselfe of the premisses afd says that of the premiss afd he is Guilty thereof and is willing to pay his fine for the fact afd &a Whereupon all and Singular the premisses by the Court here seen heard and fully understood and mature deliberation thereupon had It is Considered by the Court here that the afd John Hopkins Jun.r pay to his Lordship the Lord proprietary for his fine by the Court here upon him Imposed for and by occasion of the premisses afd whereof in form afd he is Convict to thirty shillings Currant money and that the same John Hopkins be taken to satisfie of the fine afd whereupon the said John Hopkins is ordered to give security for the payment of the fine afd but for want thereof the said John Hopkins is Committed into the Custody of the sher of Somerset County thereto remaine the said sherriff present herein Court took Charge of the said John Hoopkins accordingly also it is ordered that the said John Hopkins Give security for the payment of the Severall Officers Fees due upon the Indictment afd Whereupon a Certain Stephen Winwright of the County afd present herein Court in his proper person acknowledged himselfe Indebted unto his Lordship the Lord proprietary in the sum of five pounds sterling to be Levied on his body Goods and Chattells Lands and tenements to the Use of the Severall Officers of Somerset County Court that hath any right to any fees by means of the Indictment afd if it Happen that the Said John Hopkins do not pay the Severall Officers Fees due as afd that then he the said Stephen Winwright will do the Same for him &a Likewise the said John Hopkins Jun.r is ordered by the Court to give security for to save and keep harmless as well the Justices of Somerset County Court and their Successors for the time being as the Inhabitants of the said County for all Costs Charges and troubles by reason of the birth maintenance nourishing and bringing up of a bastard Child lately begott by him the said John Hopkins of the body of the afd Mary Maguire &a Whereupon the said John Hopkins Jun.r with a Certain Jacob Messex of Somerset County planter his security present herein Court acknowledged themselves Indebted unto his Lordship the Lord proprietary his heirs and Successors in twenty pounds sterling Each of their severall goods and Chattells Lands and tenements if it Happen that the Said John Hopkins Jun.r do not from time to time and at all times hereafter acquitt discharge and Save harmless as well the Justices of Somerset County Co.rt and |
