(14) The same day being Solemnly Called Cometh not but makes Default Therefore it is Considered that the afs.d William Kitchen and Thos Gray have Execution against the Same Dorman Heath of the Damages afs.d According to force form and Effect of the Recognizance afs.d &c.a
Whereas the Said James the Eighth day of May Anno Dom Seventeen hundred and thirty at Somerset County afs.d within the Jurrisdiction of this Court was Indebted unto the Said John in Eight pounds one shilling and three pence three farthings Currant Mony of Maryland for sundry goods wares and Merchandizes by the said John to the said James at the Especial Instance and Request of the said James before the time there sold and Delivered as by account hereunto annexed may in Court appear and being so thereof Indebted the said James in Consideration thereof ye day and year aforesaid at the County afs.d within the Jurr afs.d upon himselfe did assume and to ye said John then and there did faithfully Promise that he the said James the aforesaid Eight pounds one shilling and three pence three farthings to the Said John when he should be thereunto Requested he would well and faithfully pay and Content and altho the said James two shillings and six pence parcell of the aforesaid Eight pounds one shilling and three pence three farthings to the said John he hath paid and satisfyed yet as to seven pounds Eighteen shillings and Nine pence three farthings Residue of the aforesaid Eight pounds one shilling and three pence three farthings the said James his Promise and Assumption afs.d in form afs.d Made Nothing Regarding but plotting and fraudulently Intending ye said John in that part Craftily and Subtilly to Deceive and Defraud the aforesaid seven pounds Eighteen shillings and Nine pence three farthings to the said John alltho the same to do the said James by ye said John on ye aforesaid Eighth day of of May in the year afs.d and often afterwards at Somerset County afs.d within ye Jurr afs.d he was thereunto Requested hath not paid or Contented but the same to him hitherto to pay or Content hath Refused and still doth Refuse and Deny whereupon the said John saith he is worse and hath Damage to the Value of fifteen pounds Curr.t Money of Maryland aforesaid and thereupon he brings suite &c.a Jno Doe Pledges depr Richd Roe
