(14) of Somerset County afs.d should Render or that he the Same Dorman Heath would do the same for him as by the Records and proceeding thereof in our Same Court before our Justices Remaining Manifestly Appeareth And altho the aforesaid William and Thomas afterwards (to Witt) the fifteenth day of August Anno Dom one thousand seven hundred and thirty two before Rob.t King Gent and his Associated then our Justices of the same Court at Dividing ^Creek^ afs.d by Consideration of the same Court Recovered against the aforesd Patrick two pounds twelve Shills and Eleven pence half penny Currt Money and Two hundred and Ninety five pounds of Tob.o for their Damages which they sustained by Occasion of a Certain Promise and Assumption ^to the^ afs.d William and Thomas Lately made and not performed as for their Costs and Charges by them about their Suit in that part Expended whereof the said Patrick is Convict as by the Record and process thereof in our same Court before our Justices at Dividing Creek afsd Likewise Remaining Manifestly Appeareth Nevertheless the afsd Patrick his Body in Execution of the Judgmt afs.d to the sher of the County afs.d hath not Rendered nor the same Patrick the afs.d W.m and Thomas the Damages and Costs and Charges aforesaid hath not satisfyed as by the Insinuation of the same William and Thomas we have Received and because we are Willing that those things which in our same Court before our Justices are Rightfully done and acknowledged ought to be duly Executed We Command you that by Honest and Lawfull men of Your Balywick you make known unto the aforesaid Dorman Heath that he be and appear before our Justices of our County Court of Somerset to be held at Dividing Creek in the County afs.d the Third Tuesday of June Next to shew Cause if anything for himselfe he hath or to say knoweth wherefore the afsd William and Thomas their Execution of the Judgm.t afsd according to the form of the Recognizance afs.d ought not to have if to him it shall ^seem^ Expedient and have You then and there the Names of them before whom to him you make the same known and this Writt Wittness Rob.t King Gent Chief Justice of our said Court the twenty fourth Day of April in the Eighteenth year of our Domminion &c.a Anno Dom one thousand seven hundred and thirty three Att which said Third tuesday of June to witt the Nineteenth day of the same Month Anno Dom One thousand Seven hundred and thirty three before the Justices of his Lordships County Court of Somerset held at Dividing Creek in the County afs.d Came the afs.d William Kitchen and Thomas Gray by Levin Gale their attorney and the sher of Somerset County to witt Joshua Caldwell Gent at the same Day Returned that he by Virtue of the Writt aforesaid to him Directed had made known unto the afs.d Dorman Heath by Thos Hearn and Abraham Heath honest and Lawfull men of his balywick that he be and appear before his said Lordships Justices at the day and place afsd to shew &c.a as within to him it was Commanded and the afs.d Dorman Heath so forewarned and at the |
