    March Court    1733            147

Dom One thousand seven hundred and thirty three Came againe as well the afd Alexander Draper
as the afd Andrew Rathbone by their attorneys afd and whereupon the ^said^ Alexander prays that the
afd Andrew to his declaration afd may answer and the said Andrew altho' at the Same day Solemnly
^Called^ Cometh not nor nothing says in Barr or preclusion of the action ^afd^ of the afd Alexander by which the
same Alexander remaineth thereof against the Same Andrew undefended &a

       Wherefore the afd Alexander his damages ^by occasion of the premisses^ against the afd Andrew Ought to Recover but because
it is not know to his Lordships Justices here what damages the afd Alexander in part hath Sustained
Thereupon it is Commanded the sherriffe of Somerset that by the Oath of honest and Lawfull men of his
Bailywick he should diligently Enquire what damages the afd Alexander hath Sustained as well
by Occasion of the Non performance of the promise and assumption afd as for his Costs and Charges
by him about his Suit in that part apposed and that Inquisition which thereupon he makes he makes
appear to the Justices of his Lordships County Court of Somerset to be held at dividing Creek in the
County afd the third tuesday of March the next under his seal and the seals of them by whose oath
he takes that same Inquisition he send together with the writt thereof to him directed and the same day
is given to the afd Andrew there also &a    at which said next Court to witt the Ninteenth day of march
Anno Dom One thousand Seven hundred & thirty three before the Justices thereof at dividing Creek Cometh
the afd Alexander Draper by his attorney afd and the sherriff of Somerset County sends not thereof
his writt






Robert Harris
   Recognizance
 Robert Harris appears according to a certain Recognizance entered into for his appearance
at this Court to answer an Information for the Importation of negro's into this province
and ^not^ entering of them and paying the dutys according to Law &a    thereupon the said Robert
Harris is discharged from the same Recognizance &a and ordered to give New recognizance for his appearance
at August Court next to answer as afd &a    Whereupon the said Robert Harris present herein Court
acknowledged himselfe to owe to his Lordship forty pounds sterling to Levied &a   If it Happen that
he does not appear before the Justices of his Lordships County Court of Somerset to be held at dividing
Creek the third tuesday of August next to answer as afd &a    afterwards for reasons to his Lordships
Justices here ye said Robert Harris is Immediately discharged from the recognizance afd &a
