and Richard Roe be in mercy and that the afd John White go thereof without day &a and further it is Considered
501    that the afd John White Recover against the afd Isaac Beachamp
                               pounds of tobacco for his Costs and Charges by him about his defence in that part sustained to the
same John by the Court here according to the form of the Statute in Such Case Lately made and provided adjudged
and that ye afd deft have thereof Execution &a

 Somerset County ss    Andrew Rathbone Late of Somerset County planter was

attached to answer unto Alexander Draper of a plea of trespass upon the Case &a
                                  And Whereupon the said Alexander by Francis Allen his attorney Complaines that
whereas the said Andrew the tweny Sixth Day of August seventeen hundred and thirty at Somerset
County afd within the Jurisdiction of this Court was Indebted unto the Said Alexander in Two pounds
Twelve shillings as by a Certain Note by the said Andrew signed bearing Date the Day and Year
aforesaid and here in Court produced may appear and being so thereof Indebted the said Andrew
in Consideration thereof in and by the said Note upon himself Did assume and to the said Alexander
then and there Did faithfully promisse that he the said Andrew the said Two pounds Twelve
Shillings to the said Alexander at or before the Last Day of September he would well and faithfully
pay and Content Nevertheless the said Andrew his promisse and assumption afd made Nothing
regarding but plotting and fraudulently Intending the said Alexander in that part Craftilly
and Subtilly to Deceive and Defraud the said Two pounds Twelve shillings to the said Alexander
upon the aforesaid Last Day of September hath not paid or Contented but the same to him hitherto
to pay or Content hath refused altho' the same to Do the said Andrew by the said Alexander
was often thereunto requested and the same to the said Alexander to pay Still Doth refuse and
Deny whereupon he saith he is Worse and hath Damage to the Value of Five pounds Curr.t Money
of Maryland and thereupon he brings suite &a                                       Pledges &a    John Doe

    And the afd Andrew Rathbone by George Douglas his attorney Comes and Defends the force
and Injury when &a and prays Leave thereof to Imparle hereuntill Next Court and he hath it and
the same Day is Given to the afd Alexander Herealso &a

       Att which said next Court to Witt the Nineteenth Day of June Ann Dom One thousand Seven
hundred and thirty three Came Againe as well the afd Alexander Draper as the afd Andrew Rathbone
by their attorneys afd and whereupon the said Andrew Rathbone prays further Leave thereof to
Imparle hereuntill Next Court and he hath it and the same Day is Given to the afd Alexander
herealso &a

             Att which said Next Court to Witt the Twenty first Day of August Ann Dom One thousand
Seven hundred and thirty Three Came againe as Well the afd Alexander Draper as the afd Andrew
Rathbone by their attorneys afd and Whereupon the said Andrew Rathbone prays further Leave
thereof to Imparle hereuntill Next Court and he hath it and the same Day is Given to the afd
Alexander herealso &a
