that whereas the said John on the Fourteenth day of October Anno Dom Seventeen hundred & sixteen at Somerset County Within the Jurisdiction of this Court by Marrying Sarah Mother to the Said Isaac and Relict of Thomas Beauchamp Deceased Father of the Said Isaac Did receive and Take into his possession a Certain Plantation & Tract of Land Called Contention Scituate Lying and ^being upon the head of Annamessex river in the County of Somerset aforesd and^ Belonging to the Said Isaac then a Minor and the Said Plantation and Tract of Land So In his possession Did keep from the aforesaid fourteenth Day of October Seventeen Hundred & sixteen untill the fourteenth Day of July Seventeen hundred and Nineteen During which time the said John Did permitt & suffer the plantation aforesaid and the fence on the Same to Grow Worse and Decay to the Great Damage of the said Isaac then Still being a Minor under the age of Twenty One Years By reason whereof as also by force and vertue of an act of Assembly of this province Now In force in Such Case Lately made and provided Cap.t William Planner then one of the Comissioners of the Right Honourable the Lord Proprietary in & for the County of Somerset on the aforesaid fourteenth Day of July seventeen hundred and Nineteen together with William Catlyn & Thomas Tull both of the County of Somerset planters being Two persons of Good repute and well Skilled in building and Plantation Affairs Nominated by the Said Cap.t William Planner being the Nearest Comissioner to the place where the ^said^ Land Lyeth then and there Did Enter upon the Lands and Plantation aforesaid belonging to the said Isaac and Did Take their Corporal Oaths Upon the Holy Evangelist which said Oath was to them Administred by the Said Cap.t William Planner then being a Comissioner as aforesaid and then & there Did view the Dwelling Houses and Out houses Lands Orchards and Fences upon the Said plantation and returned a Certificate of their Said View under their hands and Seals attested by the Said Comissioner who had so administred the Oaths as aforesaid to the then Next Ensuing County Court after the Review so had and made as aforesaid as by the records and proceedings in the Said County Court remaining more plainly appears which said William Catlyn & Thomas Tull upon their view aforesaid so as aforesaid made amongst other things in the said Certificate so by them returned as aforesaid Contained Did find that the plantation had received Damages since the said John White had been possessed with it to Eight pounds Currant Money of this province as by the said Certificate upon the records of the said County Court remaining more plainly appears by reason whereof as also by force and virtue of the act of assembly afd action accrews to the said Isaac to have and recover from the said John Double damages for the damage Committed upon the plantation afd which said Double Damages amount to Sixteen pounds Curr.t money of Maryland of |
