to be held at dividing Creek in the County afd the third tuesday of March then next to answer unto Nathaniel Brittingham of a plea of trespass upon the Case &a and that thereof he should not fail &a Att which said third tuesday of march to witt the ninteenth day of the same month Anno Dom One thousand seven hundred and thirty three being the day of the return of the said Writt Cometh the said Nathaniel Brittingham by Francis Allen his attorney and the sherriffe of Somerset County to whom the foregoing writt was directed Likewise Comes and makes return thereof to the Court here Endorsed in these words following vizt Cepi Corpus p Joshua Caldwell sher the said Dennis Cordogan being Called appears and thereupon the said Dennis Cordogan at the prayer of the said Nathaniel Brittingham by his attorney afd is adjudged to give Speciall bail to the action afd but for want thereof the said Dennis Cordogan is Committed into the Custody of the sherriff of Somerset County thereto remain &a the Said Sherriff to witt Joshua Caldwell Gent present herein Court took Charge of the said Dennis Cordogan accordingly &a Afterwards in the Same Court Came a Certain George Douglas of Somerset County Gent in his proper person and undertook for the said Dennis Cordogan and assumed upon himselfe that if in Case the said Nathaniel Brittingham should recover Judgn.t in the plea afd against the said Dennis Cordogan or that the said Dennis Cordogan should be therein Convict that then he the said Dennis Cordogan shall pay the Condemnation of the Court thereupon or render his body to the Custody of the sher of Somerset County in satisfaction thereof or that he the said George Douglas will do the same for him &a Whereupon the said Dennis Cordogan by George Douglas his attorney Comes and defends the force and Injury when &a and Says that he Cannot Gainsay the action afd of the afd Nathaniel Brittingham nor Can he Say but that the said Dennis Cordogan did assume upon himselfe in Such manner and form as the afd Nathaniel Brittingham above against him hath Complained and as to the damage of the same Nathaniel by him by Occasion of the premisses in that part Sustained the Same Dennis saith and Confesseth that the afd Nathaniel has Sustained damages by Occasion of the premisses further than his Costs and Charges by him about his Suit in that part apposed to three pounds Eight shillings and Eleven pence Currant money of maryland and not more and because the afd Nathaniel denys not this but the same allegation Confesseth to be true prays Judgment for those damages above Confessed together with those Costs & Charges afd to him to be adjudged &a Therefore by Consent of the parties afd it is Considered that the afd Nathaniel Brittingham recover against the afd Dennis Cordogan his damages afd to three pounds Eight Shillings and Eleven pence Currant money of Maryland in form afd Confessed as also Two hundred 268 & Sixty Eight pounds of tobacco for his Costs and Charges afd to the same Nathaniel by the Court here and Consent of the parties afd adjudged and the afd defend.t in mercy &a Afterwards the same |
