   Patrick Burke
 Command was given to the sherriff of Somerset County that he should take Patrick Burke
     Late of Somerset County Saddler if he should be found in his bailywick and him should
safe keep so that he might have his body before the Justices of his Lordships County Court of
Somerset to be held at dividing Creek in the County afd the third tuesday of November Next to answer unto Dorman
Heath of a plea of trespass upon the Case &a and that thereof he should not fail &a

                      Att which said third tuesday of November (to Witt) the twentieth day of the same month Anno Dom
One thousand Seven hundred and thirty three being the day of the return of the said writt Cometh the said Dorman
Heath by Francis Allen his attorney and the sherriff of Somerset County to whom the foregoing writt was directed
Comes and makes Return thereof to the Court here Endorsed viz.t   Cepi Corpus p   Josa Caldwell sher

                Whereupon the said Patrick Burk in his own proper person appears here in Court and thereupon the
said Patrick Burk at the prayer of the afd Dorman Heath by his attorney afd is adjudged to give Speciall
bail to the action afd   But for want thereof the said Patrick Burk is Committed into the Custody of
the sherriffe of Somerset County there to remain &a the said sherriff to witt Joshua Caldwell gent present here
in Court took Charge of the said Patrick accordingly &a

          Att which said next Court to witt the ninteenth day of march anno Dom One thousand Seven hundred
thirty three Came againe ^as well^ the said Dorman Heath by his attorney afd as the said Patrick Burk in his Own proper
person in Custody as afd and thereupon a Certain William Holland of Somerset County Gent present
herein Court in his proper person undertook for the said Patrick Burk and assumed upon himselfe that if
in Case the said Dorman Heath should recover Judgment in the plea afd against the said Patrick Burke
or that the said Patrick Burk should be therein Convict that then he the said Patrick Burk should pay
the Condemnation of the Court thereupon or render his body to the Custody of the sherriffe of Somerset
County in Satisfaction thereof or that he said William Holland will doe the same for him &a

       And Because the afd Dorman Heath did not declare against the afd Patrick Burk nor prosecutes his
writt in the plea afd      Therefore he and his pledge of prosecuting be in merch and the plantiff name
pledges &a and that the afd Patrick Burk go thereof without day    also it is Considered that the afd Pat
Burke Recover against the the afd Dorman Heath his damages by Occasion of the premisses to One hundred
196   & Ninty Six                        pounds of tobacco to the same Patrick by discretion of the Justices here
at his request for his Costs and Charges in that part sustained according to the form of the Statute Lately made
and provided adjudged &a
