141 Att which said next Court to witt the twentieth day of November anno Dom One thousand seven Hundred and thirty three Came againe as well the afd John Tunstall as the afd Mary Porter by their attorneys afd and whereupon the said Mary prays Further Leave thereof to Imparle hereuntill next Court and she hath it and the same day is Given to the afd John here also &a Att which said next Court to witt the ninteenth day of march anno Dom One thousand seven hundred and thirty three Came againe as well the afd John Tunstall as the afd Mary Porter by their attorneys afd and whereupon the same Mary as before dends the force and Injury when &a and saith that the afd John hs action afd thereupon against her to have and maintain Ought not because she saith that she the said Mary hath fully administred all the goods and Chattells which were of the afd Hugh at the time of his death in her hands to be administred and that she hath not any of the goods and Chattells of the afd Hugh in her hands to be adminstred nor had at the day of the Impetration of the Originall writt of the afd John nor at any time afterwards and this she is ready to verifie whereupon she prays Judgment if the said John his action afd thereupon to have and maintain Ought &a Whereupon the afd Mary by her attorney ^afd^ Relinquisheth her verification afd by her above alledged and says that she Cannot Gainsay the action afd of the afd John nor Can she say but that the afd Hugh in his Life time did assume upon himselfe in manner and form as the afd John above against her hath Complained and as to the damage of the Same John by him by Occasion of the premisses in that part sustained the same Mary Saith and Confesseth that the afd John has Sustained damages by Occasion of the premisses further than his Costs and Charges by him about his suit in that part apposed to the afd fourteen pounds Seventeen shillings and Six pence Curr.t money and twelve hundred and Eighty five and a halfe pounds of tobo & not more to be Levied of the goods and Chattells of the afd Hugh when ever the Same shall Come to the hands of the afd Mary to be administred on and because the afd John denys not this but the same allegation Confesseth to be true prays Judgmt for those damages above Confessed together with his Costs and Charges afd to him to be adjudged &a Therefore by Consent of the parties afd it is Considered that the afd that the afd John Tunstall recover against the afd Mary Porter Executrix of the same Hugh Porter his damages afd to the afd fourteen pounds seventeen shillings and six pence Curr.t money of Maryland & twelve 370 and seventy pounds of tob.o for his Costs and Charges afd to the Same John by the Court here and Consent of the parties afd Adjudged to be Levied of the Goods and Chattells which were of the afd Hugh Porter at the time of his death and which to the hands of the said Mary Executrix as afd hereafter shall happen to Come to be administred & the afd deft in Mercy &a |
