half pounds of Tobacco the said Hugh in his Life Time and the aforesaid Mary since the
Decase of the aforesaid Hugh the promise and assumption of the said Hugh in his Life
Time so as aforesaid made Nothing regarding but plotting and fraudulently Intending the
said John in that part Craftilly and Subtilly ^Deceive and^ Defraud the Said Fourteen pounds seventeen
Shillings and six pence and One thousand Two hundred Eight five and a half pounds of
Tobacco to the Said John hath not paid or Contented Nor Either of them hath paid or
Contented altho' the same Hugh in his Life Time afterwards (to Witt) on the aforesaid
Twenty Sixth Day of March in the Year aforesaid and the said Mary since the Decease of
the said Hugh (to Witt) the Tenth Day of April One thousand seven hundred and thirty Two
and Often afterwards at the County aforesaid within the Jurisdiction aforesaid was thereunto
Requested by him the said John but the same to the said John to pay the said Hugh in his
Life Time hath refused and the same to the said John to pay the said Mary Still Doth
refuse and Deny whereby the said John saith he is the Worse and hath Damage to the Value of
Forty pounds Curr.t Money as aforesaid and thereupon he brings suit &a      Pledges &a John Doe

             And the afd Mary Porter Executrix of the same Hugh by Francis Allen her attorney Comes and defends
the force and Injury when &a and prays Leave thereof to Imparle hereuntill next Court and she
hath it and the same day is Given to the afd John here also &a

          Att which said next Court to witt the ninteenth day of June anno Dom One thousand seven hundred &
Thirty three Came againe as well the afd John as the afd Mary by their attorneys afd and whereupon the
said Mary prays further Leave ^thereof^ to Imparle hereuntill next Court and she hath it and the same day is
Given to the afd John here also &a

                         Att which said next Court to witt the twenty first day of August anno Dom One thousand
seven hundred and thirty three Came againe as well the afd John Tunstall as the afd Mary Porter by
their attorneys afd and whereupon the Same Mary prays further Leave thereof to Imparle hereuntill
