133 against him hath Complained and of this he putts himselfe upon the Country &a and the plft likewise Thereupon it is Commanded the sherriffe of Somerset County that Immediately he should Cause to Come here before the Justices of his Lordships County Court of Somerset now in Court Sitting at dividing in the County afd twelve &a by whom &a and who neither &a ^to recognize &a^ because as well &a and afterwards Immediately Came thereof the Jury &a and the Jurors of that Same Jury by Joshua Caldwell Gent sherriffe of the County afd to this Impannelled being Called Came to witt Edward Beachamp Parker Selby Thomas Dixon, George Tull, Littleton Townsend Robert Mitchell, Joshua Sturges, George Benston Will.m Mills, Thomas Reyly W.m Holland and John Fleming who to Say the truth of the premisses being duely Elected tryed and Sworn upon their Oath did Say that the afd Hutton Hill did assume upon himselfe in such manner and form as the afd Ambross Willett above against him hath Complained and assessed the damage of the same Ambross beyound his Costs and Charges by him about his suit in that part apposed to three pounds ten shillings Curr.t money of Maryland and for those Costs and Charges to one pound of tobacco Whereupon the afd Hutton Hill prays the Court here that according to act of assembly in such Case made and provided that they would dissolve themselves into a Court of Chancery and give Judgmt in the premisses afd according to the rules in Equity &a Afterwards in the Same Court Came the said Hutton Hill and Says that he Cannot Gainsay but that the said Ambross Willett should Recover against him ^for^ the afd three pounds ten shillings Curr money and One pound of tobacco the damages afd by the Jurors afd assessed and not more and because the afd Ambross deny's not this but the same allegation Confesseth to be true prays Judgment for those damages afd together with his Costs and Charges afd ^to him to be^ adjudged &a Therefore by Consent of the parties afd it is Considered that the afd Ambross Willett recover against the afd Hutton Hill his damages afd to three pounds ten shillings Curr mony and one pound 2246 of tobacco and in form afd Confessed as also Two thousand two hundred & Forty Six pounds of tobacco for his Costs and Charges afd to the same Ambross by the Court here of his assent adjudged & the afd deft in mercy &a
the said Saul is a good true honest and faithfull Liege Subject of Our Lord the King that now is and as a good true honest and faithfull Liege Subject of the said King now and his progenitours Kings and Queens of the Realm of great Brittain from the time of his Nativity hitherto hath behaved Lived and Continued himselfe and of good name fame Condition and Conversation and Gesture amongst all his Neighbours and Other faithfull ^& worthy^ Subjects of Our Lord the King by the whole time afd was Esteemed and reputed always setting God before his Eyes and of all Kind of theft felony Larceny fraud |
