133 fraud deceipt or the procuring of any Such Crime or Wickedness and from all manner of Noted Blott or Suspicion whatsoever of any of them by the whole Course of his Life hitherto Except free Innocent untouched unspotted and altogether unsuspected hath Lived and remained by reason whereof the said Saul not only the favour Love and Good Will of his Neighbours and other faithfull Liege Subjects of Our Lord the King now had and Obtained but also himself fame Creditt Lands Tenements and all and Singular his Goods and Chattles safe and unhurt hath kept and preserved in Nowise subject to the Rigor of the Law for such Like Offences made and provided Nevertheless the aforesaid Thomas not being Ignorant of the premisses but Envying the happy Estate and Condition of the said Saul Mallitiously plotting and Develishly Intending the said Saul not Only of his Good Name fame Creditt and Esteme aforesaid to Deprive and spoile and him the said Saul into the hatred and Evil Oppinion of all his Neighbours and Other faithfull Liege Subjects aforesaid to Induce and bring but also to Cause him Inocently to be brought in Danger of suffering Corporal Punishment and for feiting four fold as the Law in Such Cases Directs the aforesaid Thomas the Twenty Sixth Day of February Ann Dom seventeen hundred and thirty Two at the house of a Certain Samuel Mayo in Nasswatax Neck in the County of Somerset aforesaid Within the Jurisdiction of this Court then and there haveing Communication and Speech with sundry faithfull subjects of Our Lord the King now his Neighbours Concerning same hoggs then and there Lying Dead and Killed by the said Samuel Mayo ^being of the ^lawfull^ proper master of the said Samuel Mayo^ these false feigned Scandalous Opprobrious ^& Malitious^ Words following of him the said Saul in the presents and hearing of sundry Liege subjects of Our Lord the King now then and there being present and hearing then and there openly and publickly falsely and Malitiously did Speak Assert pronounce and with a Loud Voice publish viz.t I (himself the said Thomas Meaning) saw Saul Townsend (the aforesaid Saul Townsend meaning) bring home (to the Dwelling ^house^ of the said Saul Meaning) Two Dead Hoggs of your marke (meaning two Dead Hoggs belonging to and of the proper Marke of the said Samuel Mayo) and Called me up to help to Clean them when as in truth the said Saul no such wicked and base Crime Ever Comitted or perpetrated by reason of the speaking publishing and Declaring of which false Infamous and Scandalous words the said Saul not only in his Good Name fame Creditt and repute aforesaid is Very Much hurt but also Sundry Sums of Money and Tobacco for Asserting and Clearing his Innocency in that part is forced to Lay Out and Expend to the Damage of the said Saul of tenn thousand pounds of Tobacco and thereupon he brings Suite &a pledges &a John Doe & R: Roe And the afd Thomas Kellsick by George Douglas his attorney Comes and defends the force and Injury when |
