(132) there faithfully promise that he the said Hutton the afd seven pounds Cur.t Money when therto afterwards Required to the Said Ambross would well and faithfully Content and pay and altho' the said Hutton hath paid to the said Ambross the sum of three pounds ten Shillings part of the sum afd Nevertheless as to Other three pounds Two Shillings Residue of the Said Seven pounds the afd Hutton his promise and assumption afd in Manner and form afd made not Regarding but minding and fraudulently Intending the Said Ambross in that part Craftilly and Subtilly to Deceive and Defraud the afd Sum of Three pounds Ten Shillings Curt Residue of the said seven pounds Curt Money or any part thereof to the said Ambross hath not paid or any Ways Contented altho' the same to Doe by the said Ambross on the second Day of January afd in the Year afd at the place and within the Jurisdiction of this Court and Often afterwards required but the same to him hitherto to pay hath ^altogether^ Refused and Still Doth Refuse to the Damage of the Said Ambross Seven pounds Cur.t Money and and thereof he brings Suit &a Pledges &a Jn.o Doe & R Roe The said Hutton Hill present here in Court in his proper person at the prayer of the afd Ambross Willet by his attorney afd is adjudged to give Speciall bail to the action afd thereupon a Certain John Owten of Somerset County planter present herein Court undertakes for the said Hutton Hill and did assume upon himselfe that if in Case the said Ambross WIllett should recover Judgm.t against the said Hutton Hill in the plea afd or that the said Hutton Should be therein Convict that then he the said Hutton Hill should pay the Condemnation of the Court thereupon or Render his body to the Custody of the sheriffe of Somerset County in Satisfaction thereof or that he the said John Owten will do the same for him &a And the afd Hutton Hill by Francis Allen his attorney Comes and defends the force and Injury when &a and prays Leave thereof to Imparle hereuntill next Court and hath it and the same day is given to the afd Ambross herealso &a Att which said next Court to witt the twenty first day of August anno Dom One thousand Seven hundred and thirty three Came again as well the afd Ambross Willett as the afd Hutton Hill by their attorneys afd And whereupon the said Hutton prays further Leave thereof to Imparle hereuntill next Court and he hath it and the same day is given to the afd Ambross here also &a Att which said next Court to witt the twentieth day of November Ann Dom One thousand Seven hundred and thirty three Came again as well the afd Ambross Willett as the afd Hutton Hill by their attorneys afd and whereupon the afd Hutton prays further Leave thereof to Imparle hereuntill next Court and he hath it and the same day is given to the afd Ambross here also &a Att which said next Court to witt the Ninteenth day of March Anno Dom One thousand seven hundred and thirty three Came againe as well the afd Ambross Willett the afd Hutton Hill by their attorneys afd and whereupon the same Hutton as before defends the force and Injury when &a and saith that he did not assume upon himself in manner and form as the said Ambross above ag.t |
