1733 131 Caldwell Gent sherriff of the County afd to this Impannelled being Called Came to witt Edward Beachamp Parker Selby, George Tull, Littleton Townsend Robert Mitchell, Joshua Sturges, George Benston William Mills, Thomas Reley William Holland John Fleming and Thomas Dixon who to say the truth of the premisses being duely Elected tryed and Sworn upon their Oath did say that the afd Aaron Lynn did speak utter and pronounce the scandelous and Infamous words of the afd John as he in his declaration afd above against him hath Complained and did assess the damages of him the Said John by Occasion of the premisses afd beyound his Costs and Charges by him about his suit in that part apposed to forty One shillings and six pence Curr.t money of Maryland and for those Costs and Charges to One pound of tobacco &a Therefore it is Considered that the afd John Hovington Recover against the afd Aaron Lynn the damages afd by the Jurors afd in form afd assessed as also fifteen hundred & four pounds pounds of tobacco for his Costs and Charges afd to the same John by the Court here of his assent of Increase adjudged which Certain damages in the whole do amount there in the whole to forty one shillings & six pence Curr 282 money and fifteen hundred and four pounds of tobacco and the afd deft in mercy &a
And whereupon the said Betty by William Beckingham her attorney Saith that whereas at a County Court of the Right Honrble the Lord Proprietary of this province that now is held at Dividing Creek in the County of Somerset in and for the County of Somerset the Third Tuesday of August Ann Dom One thousand Seven hundred and thirty being the Eighteenth Day of the same Month before Samuel Hopkins Gent and his Associates Justices of the Same Court she the said Betty by Consideration of the Same Court Recovered against the afd William thirty pounds Currant money of Maryland a Certain Debt as also three hundred and fifty one pounds of Tobacco for her Damages which She sustained as well by Occasion of the Detaining of the same Debt as for her Costs and Charges by her about her Suit in that part apposed whereof he is Convict as by the Record and process thereof in the same Court before the Justices thereof at Dividing Creek afd Remaining fully appears which said Judgement as Yett Remains in full Strength Vigor and Effect and Altogether Unreversed Annuled or Satisfied and the same Betty as Yett Did not Sue Out Any Execution On the same Judgement by Which Action Accrews to the same Betty to have of the afd William the afd thirty pounds Currant money and three hundred and fifty one pounds of tobacco Nevertheless the afd William tho' Often Required the said thirty pounds Currant Money and three hundred ^and fifty^ One pounds of Tobacco to the said Betty hath not rendered but the same to her hitherto to Render hath Denyed and the same still Doth Deny and Unjustly Detaine to the Damage of the same Betty of sixty pounds Like money & seven hundred & two pounds of Tobacco & thereof she bring Suit &a pledges John Doe & R Roe |
