130 seven hundred and thirty three Came againe as well the afd John Hovington as the afd Aaron Lynn by their attorneys afd and whereupon the said Aaron prayeth further Leave thereof to Imparle here untill next Court & he hath it and the same day is given to the afd John here also &a Att which Said Next Court to witt the Twentieth Day of November Ann Dom One thousand afd Aaron Lynn by their attorneys afd and whereupon the sd Aaron prays further Leave thereof to Imparle here untill Next Court and he hath it and the Same Day is Given to the afd John here also &a Att which said Next Court to Witt the Nineteenth Day of March Ann Dom One thousand Seven hundred and thirty three Came again as well the afd John Hooffington as the aforesaid Aaron Lynn by their attorneys afd and whereupon the sd Aaron as before Defends the force and Injury when &a and Says that the afd John his Accon afd thereof against to have and maintain Ought not because he says that well and True it is that before the Speaking and publishing the words in the Declaration afd above Mentioned viz.t on the first Day of aprill Ann Dom Seventeen hundred and thirty at the County aforesaid within the Jurisdiction of this Court a Certain Dispute and Difference happened between the afd John and a Certain Robert Givens in a Matter of Account between the said Hooffington ^and ye said Givans^ and the said Matter being Legally at Issue between the said Hooffington and the said Givens the said John Hooffington on the Tryall thereof (before John Handy Gent One of his Lordships the Right honourable the Lord proprietary of this province Justices of the peace for this County who had Legall Jurisdiction of the Cause) was Sworn before the said John Handy On the Holy Evangelist of Almighty God to say the truth the whole truth and Nothing but the Truth on the Issue afd and being thereupon Interrogated upon his Oath aforesaid if he the said Hooffington Did not Agree with the sd Givens to Endeavour to have some shingles of the said Givens which before the Time had been Shipwrecked and that for his the said Hooffingtons Labour ^thereon^ bestowed he should receive no Other reward of the said Givens that what he Could save and preserve of the shingles afd and if None of the said shingles were saved that he the s.d Hooffington should have Nothing for his Labour afd the afd John Hooffington on his Oath afd Did Declare that no such agreement was made and that he the said shingles whether the same or any of them were saved or not whereas in Truth the said John Hooffington Did Agree with the said Givens before any Labour in preservation of the said shingles by the said Hooffington was bestowed that if none of the said shingles were preserved that the said Hoofington should (be |
